12/17/2007

the Regional Water Quality Control Board (RWQCB). As required by these agencies, the
applicant shall prepare and implement an HMMP that includes a compensatory mitigation plan
to replace saline emergent waters of the U.S. filled by the project. Such an HMMP would be
required by the Corps of Engineers as a condition of the Section 404 permit and the by the
RWQCB as a condition of Section 401 Clean Water Certification or Waiver.

The City of Redwood City shall not issue a grading permit for the project until the
permits have been obtained by the applicant and the associated mitigation and monitoring plans
are approved by the responsible agencies.

Findings: Implementation of these measures would reduce this potential impact
to a less-than-significant level.

G. Loss of Fresh Emeraent Wetlands

Potential Impact 8-7: The proposed project would fill fresh emergent wetlands.
Loss of fresh emergent wetlands would represent a potentially significant impact.

Mitigation 8-7: The applicant shall implement Mitigation 8-6. The City of
Redwood City shall not issue a grading permit for the project until the permits have been
obtained by the applicant and the associated mitigation and monitoring plans have been
approved by the responsible agencies.

Findings: Implementation of these measures would reduce this potential impact
to a less-than-significant level.

H. Bird Collisions

Potential Impact 8-8: The project proposes to construct up to ten 100- to 120-
foot-high buildings. Such structures are likely to cause substantial bird collision mortality due to
lighting and window hazards. These collisions are inevitable and constitute a significant
unavoidable impact.

Mitigation 8-8: Although bird collisions are a significant unavoidable impact,
collisions may be reduced by adopting, as part of the project's architectural review process, a
lighting policy that strives for minimal exterior night-lighting, requires adoption of low-intensity
exterior lighting, uses cutoff lights and shielding techniques that focus exterior light downward,
and includes perimeter lights that are timed by project management to shut off automatically
when not in use.

Findings: Mitigation 8-8 is feasible, and would substantially reduce the
potentially significant environmental impact of bird collisions, but not to a less-than-significant
level. The remaining bird collision impacts are therefore a significant unavoidable impact.
The only way to entirely eliminate or reduce this impact is to substantially reduce the size and
scope of the Project which would effectively eliminate the affordable housing component and
other projects benefits. This impact is also overridden by project benefits as set forth in the
statement of overriding considerations.

Atty/Reso/Reso.1772
121707

22

14829
Muff# 613
