<br />12/17/2007 <br /> <br />MMRP, that mitigation measure is adopted and incorporated from the Addendum <br />into the MMRP by reference and adopted as a condition of approval. <br /> <br />5. This Council hereby finds and recognizes that the FEIR contains additions, <br />clarifications, modifications and other information in its responses to comments on the Draft <br />Environmental Impact Report for the Project ("DEIR") and also incorporates information <br />obtained by the City since the DEIR was issued. This Council hereby finds and determines that <br />such changes and additional information are not significant new information as that term is <br />defined under the provisions of the California Environmental Quality Act, because such changes <br />and additional information do not indicate that any new significant environmental impacts not <br />already evaluated would result from the Project and do not reflect any substantial increase in <br />the severity of any environmental impact; and that no feasible alternatives considerably different <br />from those analyzed in the DEIR have been proposed that would lessen significant <br />environmental impacts of the Project. Accordingly, this Council hereby finds and determines <br />that recirculation of the FEIR for further public review and comment is not warranted. <br /> <br />6. This Council hereby finds and recognizes that the Addendum to the 2003 <br />Environmental Impact Report for the Marina Shores Village Project describes the changes and <br />additions to the 2003 MSV EIR necessary to achieve CEQA compliance for the currently <br />proposed Peninsula Park project. This Council hereby finds and determines that, on the basis <br />of substantial evidence in light of the whole record, such changes and additional information set <br />forth in the Addendum are not significant new information as that term is defined under the <br />provisions of the California Environmental Quality Act, because such changes and additional <br />information do not indicate that any new significant environmental impacts not already evaluated <br />would result from the Peninsula Park Project and do not reflect any substantial increase in the <br />severity of any environmental impact; and that no feasible alternatives considerably different <br />from those analyzed in the DEIR and FEIR have been proposed that would lessen significant <br />environmental impacts of the Project. <br /> <br />7. This Council does hereby designate the Planning Manager of the City of <br />Redwood City, at her office at 1017 Middlefield Road, P.O. Box 391, Redwood City, California <br />94064-0391 as the custodian of documents and record of proceedings on which this decision is <br />based; and <br /> <br />8. This Council does hereby make the foregoing findings with respect to the <br />significant effects on the environment of the Peninsula Park Project, as identified in the <br />Addendum to the 2003 Environmental Impact Report for the Marina Shores Village Project <br />(Addendum), and further described and evaluated in the Final Environmental Impact Report <br />(FEIR) for the Marina Shores Village Project, with the stipulations that all information in these <br />findings are intended as a summary of the full administrative record supporting the Addendum <br />and FEIR, which full administrative record should be consulted for the full details supporting <br />these findings, and that any mitigation measures and/or alternatives that were suggested by <br />commenters to the Draft Environmental Impact Report for the Marina Shores Village Project and <br />were not adopted as part of the FEIR are hereby expressly rejected for the reasons stated in the <br />FEIR and the responses to the comments set forth in the FEIR and elsewhere in the record. <br /> <br />9. Severabilitv. If any term, provision, or portion of these Findings or the application <br />of these Findings to a particular situation is held by a court to be invalid, void or unenforceable, <br />the remaining provisions of these Findings, or their application to other actions related to the <br /> <br />Atty/Reso/Reso.1772 <br />121707 <br /> <br />6 <br /> <br />14829 <br />Muff# 613 <br />
