12/17/2007

2. Implement Mitigations 5-7 (Internal Visual Relationship of Project Development to
Electrical Transmission Lines) and 13-1 (Project Compatibility with the Existing Noise
Environment) identified in chapters 5 (Visual Factors) and 13 (Noise) of the EIR in order
to reduce the potential visual and noise impacts of the existing electrical transmission
lines to less-than-significant levels.

Findings: Implementation of these measures would reduce this potential land
use compatibility impact to a less-than-significant level.

B. Industrial and Airport Compatibilitv

"t'

Potential Impact 4-1 a: The proposed project would be located in the vicinity of existing,
extended-hour heavy commercial and industrial uses in the Bair Island Road/Seaport
Boulevard/Port of Redwood City area, as well as below existing San Carlos Airport flight
operations. Activities associated with the existing heavy commercial and industrial uses in the
area (e.g., asphalt batch plant, concrete ready mix batch plant, heavy equipment yards, metal
recycling operations) present potential incompatibilities with the proposed residential component
of the project, including possible visual impacts (light intrusion and glare, visual distraction),
traffic conflicts, noise and vibration, air quality (especially dust), and City land use policies
regarding compatibility between future uses and existing heavy commercial and industrial uses
in the area. Each of these environmental issues has been individually evaluated and discussed
in the EIR, including in chapters 4 (Land Use), 5 (Visual Factors), 7 (Transportation and
Circulation), 13 (Noise), and 15 (Air Quality). Similarly, potential impacts on the proposed
project associated with San Carlos Airport overflights have been evaluated and discussed in
EIR chapter 13 (Noise).

The EIR concludes that, based on factors of distance and separation, industrial traffic patterns,
prevailing winds, and applicable noise attenuation requirements, such impacts would be less-
than-significant. Nevertheless, the introduction of multi-story residences in the vicinity of
existing heavy commercial and industrial activities in the Bair Island Road/Seaport
Boulevard/Port of Redwood City area and beneath San Carlos Airport overflights could result in
an increase in nuisance complaints about, and requests to limit, some of these heavy
commercial, industrial, and airport operations and associated visual, traffic, noise/vibration, and
air quality nuisance aspects.

Mitigation 4-1a: To inform potential project residents of the existing heavy
commercial and industrial activities in the Bair Island Road/ Seaport Boulevard/Port of Redwood
City area, flight operations from San Carlos Airport, and possible perceptions of associated
nuisance characteristics, the EIR authors recommend that the City establish, as a condition of
project approval, a requirement, formulated to run with the project property title, that: (1)
prospective project residents (including prospective purchasers and tenants) of all project
residential units shall be notified in writing by the seller or person offering a unit for rent that
there are existing extended-hour, heavy commercial and industrial activities in the area, as well
as airport flight operations associated with San Carlos Airport, that may have perceived daytime
and nighttime visual, traffic, noise/vibration, and/or air quality-related nuisance effects; and (2)
this written disclosure shall be included in the sale and rental agreement materials to be signed
by the prospective project residents. This disclosure document would require the
buyer's/tenant's initials and acknowledgment, and the same disclosure language would also be
included in the property Covenants, Conditions, and Restrictions (CC&Rs).

Atty/Reso/Reso.1772
121707

2

14829
Muff# 613
