This finding is not applicable as the project is residential. <br />The provision of permeable areas and drainage design appropriate to <br />capture and treat stormwater runoff prior to its discharge from the site <br />including, but not limited to, the use of vegetated swales, landscape <br />features, permeable pavement materials, infiltration basins or engineered <br />designs. <br />The project would be located within the existing footprint and would not involve <br />additional grading or increased runoff. Water permeability would be maintained. <br />4. Historic Preservation Ordinance Finding. The Planning Commission is able <br />meet the criteria as stated in the Historic Preservation Ordinance (Municipal Code <br />Section 40.13). Specifically, the Planning Commission finds that: <br />A. Nothing in this Chapter shall be construed to prevent any measures of <br />construction, alteration or demolition necessary to correct the unsafe or <br />dangerous condition of any structure, or feature or part thereof, covered by <br />this Chapter, where such condition has been declared unsafe or dangerous <br />by the Building Official or the Fire Marshal, and where the proposed <br />measures have been declared necessary by such officials to correct such <br />condition; provided, however, that only such work as is reasonably <br />necessary to correct the unsafe or dangerous condition may be performed. <br />In making a determination as to whether such work is reasonably necessary <br />as aforesaid, the above-mentioned officials may refer to, and be guided by, <br />the State Historical Building Code (H&S Code section 18950 et seq.) as the <br />same may from time to time be amended, revised, or replaced. <br />The applicant has submitted a letter from a structural engineer that verifies the <br />condition of the porte-cochere and concludes that the porte-cochere as a safety <br />hazard and should be removed immediately. Staff have analyzed this report and <br />are in agreement with the findings, concluding that for safety reasons, the porte- <br />cochere should be removed. As noted in the staff report, the porte-cochere was <br />demolished on August 30, 2019. <br />5. The Architectural Permit is hereby granted based on the Planning <br />Commission's consideration of and reliance on the CEQA categorical exemption, Section <br />15301 Class 1(e) (2) (Existing Facilities) and Section 15331, Class 31 (Historic Resource <br />Restoration/Rehabilitation), and the required permit findings and in accordance with the <br />plans, detail and descriptions contained therein and subject to the Conditions of Approval <br />in Exhibit A. <br />6.
