<br />6.38 <br />Page 1 <br /> <br />ORDINANCE NO. <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDWOOD <br />CITY APPROVING THE DEVELOPMENT AGREEMENT BY AND <br />BETWEEN THE CITY OF REDWOOD CITY AND R.C. PENINSULA <br />PARK, LLC FOR THE DEVELOPMENT OF THE PENINSULA PARK <br />DEVELOAMENTPROJECT <br /> <br />WHEREAS, RC. Peninsula Park, LLC, a Delaware limited liabUity company (the <br />"Developer") is the owner of certain real property located within the City (the "Property"); <br />and <br /> <br />WHEREAS, Government Code Sections 65864 through 68569.5 provide the <br />statutory authority for the development agreements between municipalities and owners <br />of real property; and <br /> <br />WHEREAS, the Developer applied for a Development Agreement to allow for <br />the construction of a development project upon the Property consisting of up to <br />approximately 796 residential units, 10,000 rentable square feet of commercial retail <br />and restaurant space, and a hotel of up to 200 rooms, together with open space, <br />streets, walkways, waterfront esplanades and ancillary facilities (the "Project"); and <br /> <br />WHEREAS, in compliance with California Environmental Quality Act regulations, <br />on July 8, 2003 the Planning Commission of the City of Redwood City certified an <br />Environmental Impact Report for the Marina Shores ViHage Development; and <br /> <br />WHEREAS, in compliance with California Environmental Quality Act regulations, <br />on November 13, 2007 the Planning Commission of the City of Redwood City <br />considered an Addendum to the 2003 Environmental Impact Report for the Marina <br />Shores Village Project; and <br /> <br />WHEREAS, on December 11, 2007 the Planning Commission of the City of <br />Redwood City recommended approval of the Draft Development Agreement by and <br />between R.C. Peninsula Park LLC and the City of Redwood City to the City Council; <br />and <br /> <br />WHEREAS, on May 24, 2004 the City Council adopted an ordinance to amend <br />the Strategic General Plan of the City to amend the General Plan designation of <br />property located at the Peninsula Marina (APN 052-531-020; 052-531-030; 052-531- <br />050; 052-531-070; 052-531-100; 052-531-110; 052-531-120) and Bair Island Road <br />(APN 095-030-090) from Commercial-Office Park to Mixed Use; and <br /> <br />WHEREAS, on , 2007 the City Council introduced an ordinance <br />amending Article 60, zoning map no. 22 of Ordinance no. 1130, the Redwood City <br />Zoning Ordinance, as amended to rezone properties located with the Peninsula Park <br /> <br />Atty/Ord/Ord.296 <br />010708 <br /> <br />1 <br />
