1/14/2008 <br /> SECTION 1. FINDINGS. The City Council finds that the provisions of the <br /> Development Agreement by and between the City and the Developer for the <br /> construction of the Project (the "Development Agreement") are consistent with the <br /> General Plan as amended, the Precise Plan as adopted, and the Zoning Ordinance as <br /> amended of the City. <br /> SECTION 2. APPROVAL.The City Council hereby approves and adopts the <br /> Development Agreement, as herein-above amended, that was presented to the City <br /> Council at their meeting on December 17, 2007, and was filed and made available at <br /> the Office of the City Clerk, and incorporated herein by this reference. The City <br /> Manager and the City Clerk are hereby authorized and directed to execute and attest, <br /> respectively, the Development Agreement on behalf of the City. <br /> SECTION 3.
