7.C. - Page 133 of 178 <br />Exhibit E <br />Prohibited and Restricted Uses <br />The following uses are prohibited under this Lease. All terms under this Exhibit G shall have the <br />meanings normally given to such terms. <br />1. No portion of the YMCA Site shall be used for any of the following purposes: an <br />establishment engaged in the business of selling, exhibiting or delivering pornographic or <br />obscene materials; a so-called "head shop"; off-track betting parlor; a warehouse; a <br />discotheque, adult entertainment facility; bowling alley; skating rink; billiard or pool hall; <br />massage parlor; a beauty school, barber college; industrial, residential or manufacturing uses; <br />house of worship; a medical marijuana dispensary or other business or activity related to the <br />cultivation, possession, manufacture, processing, storing, laboratory testing, labeling, <br />transporting, distribution or sale of medical marijuana or a medical marijuana product or <br />device; bar, tavern or cocktail lounge, unless it is for individual or special events (i.e. annual <br />fundraiser) in which no off site sales are made and only on -premises consumption is allowed. <br />2. No portion of the YMCA Site shall be used (i) for the maintenance of any nuisance or the <br />conduct of any activity that violates public policy; (ii) for any activity that physically interferes <br />with the business of any other owner or occupant of any other parcel or property on the <br />Project Site; (iii) in violation of any law or governmental regulation; (iv) for the storage of any <br />items or vehicles, other than the storage of items within the confines of any building located <br />within the YMCA Site, which items are incidental to the business conducted thereon, and other <br />than trash to be stored in appropriate containers within an enclosed trash area; (v) to permit <br />advertising media which can be heard or experienced from the exterior of the YMCA Site, from <br />which it emanates, such as flashing lights, searchlights, loudspeakers, phonographs, radios, <br />televisions or any computer devices, in violation of the Redwood City Municipal Code; (vi) or for <br />any other unreasonable use not compatible with the operation of the Project Site or in violation <br />of the Redwood City Municipal Code. <br />Exhibit E <br />N:\DATA\Client\Y\YMCA\Docs\YMCADraftGroundLease.vl(11.6.19) <br />82483.00016\32493585 5 <br />556 <br />
