<br />6. RCSD'S INSURANCE <br /> <br />RCSD will obtain and maintain for the duration of the Agreement any and <br />all amendments, insurance against claims for injuries to persons or <br />damage to property which may arise out of or in connection with <br />performance of the Services by RCSD or RCSD's agents, <br />representatives, employees or subcontractors. The insurance will be <br />obtained from an insurance carrier admitted and authorized to do <br />business in the State of California. The insurance carrier is required to <br />have a current Best's Key Rating of not less than "A-V." <br /> <br />6.1 Coveraoes and Limits. RCSD will maintain the types of coverages <br />and minimum limits indicated below, unless Risk Manager or City <br />Manager, in consultation with the City Attorney approves a lower amount. <br />These minimum amounts of coverage will not constitute any limitations or <br />cap on RCSD's indemnification obligations under this Agreement. <br />Contractor, its officers, agents, volunteers and employees make no <br />representation that the limits of the insurance specified to be carried by <br />RCSD pursuant to this Agreement are adequate to protect RCSD. If <br />RCSD believes that any required insurance coverage is inadequate, <br />RCSD will obtain such additional insurance coverage, as RCSD deems <br />adequate, at RCSD's sole expense. <br /> <br />6.1.1 Commercial General Liability Insurance. $1,000,000 <br />combined single-limit per occurrence for bodily injury, personal <br />injury and property damage. If the submitted policies contain <br />aggregate limits, general aggregate limits will apply separately to <br />the work under this Agreement or the general aggregate will be <br />twice the required per occurrence limit. <br /> <br />6.2 Submission of Insurance Policies. Contractor reserves the right to <br />require, at anytime, complete and certified copies of any or all required <br />insurance policies. <br /> <br />6.3 Reduction in Coveraoe/Material Chanoes. RCSD will notify <br />Contractor thirty (30) days prior to any reduction in any of the insurance <br />coverage required pursuant to this Agreement or any material changes to <br />the respective insurance policies. <br /> <br />7. WAIVER <br /> <br />No delay or omission by either party in exercising any right under this <br />Agreement shall operate as a waiver of that or any other right or prevent <br />a similar subsequent act from constituting a violation of the Agreement. <br /> <br />8. EQUAL EMPLOYMENT OPPORTUNITY <br /> <br />In connection with the performance of the Agreement, the <br />CONTRACTOR shall not discriminate against any employee or applicant <br />for employment because of race, religion, color, sex, physical handicap, <br />or national origin. <br /> <br />ATTY/AGR/2007.100 RCSD SRO <br />120407 <br />
