12/16/2019 ORDINANCE NO. 2474 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDWOOD CITY ADDING ARTICLE X TO CHAPTER 2 THE REDWOOD CITY MUNICIPAL CODE RELATING TO AUTHORITY TO EXECUTE CONTRACTS WHEREAS, Section 67 of the City Charter provides that "[a]II contracts entered into by the City shall be signed by the City Manager and any other officer or officers of the City as the Council may by ordinance provide'; and WHEREAS, the City Council wishes to amend the Redwood City Municipal Code to authorize the City Manager, their designee, and any other City official authorized by an ordinance or resolution adopted by City Council to execute contracts. NOW, THEREFORE, THE COUNCIL OF THE CITY OF REDWOOD CITY DOES ORDAIN AS FOLLOWS: Section 1. The recitals set forth above are true and correct, and are hereby incorporated herein by this reference as if fully set forth in their entirety. Section 2. This Ordinance is not a project within the meaning of section 15378 of the CEQA Guidelines because it has no potential for resulting in physical change in the environment, either directly or ultimately. In the event that this Ordinance is found to be a project under CEQA, it is subject to the CEQA exemption contained in CEQA Guidelines section 15061(b)(3) because it can be seen with certainty to have no possibility of a significant effect on the environment. Section 3. The City Council of the City of Redwood City hereby adds Chapter 2, Article X to the Redwood City Municipal Code, which shall read as follows: ARTICLE X. - CONTRACTS Sec. 2.139. - AUTHORITY TO EXECUTE CONTRACTS: All written contracts shall be signed by the City Manager, their designee, or a person authorized by an ordinance or resolution adopted by the City Council. Section 4. If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portion or sections of this Ordinance. The City Council of the City of Redwood City hereby declares that it would have adopted the Ordinance and each section, subsection, sentence, clause or phrase thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared unconstitutional. Section 5. This Ordinance shall go into effect thirty (30) days following its adoption.
