No action will be taken at the study session; a staff recommendation for a new <br />ADU ordinance will be presented at a future meeting <br />RECOMMENDATION <br />Hold joint session to provide an overview of new State law requirements and obtain feedback on proposed <br />amendments to the City's ADU Ordinance to comply with State law. <br />STRATEGIC PLAN GUIDING PRINCIPLE <br />Housing <br />BACKGROUND <br />In October 2019, the State Legislature passed three new bills requiring cities to further ease local <br />restrictions on Accessory Dwelling Units (ADUs) (also commonly known as second units or in-law units) <br />and to allow new types of ADUs in residential dwellings. State law restricts what cities may require when <br />new ADUs are considered with the intent of further reducing barriers and streamlining approvals to <br />accommodate the development of ADUs. Overall, these new rules reduce the timeline for permit review, <br />allow construction of junior ADUs (interior conversions of less than 500 sq. ft. with at least an efficiency <br />kitchen) within single-family homes, allow ADUs in multifamily buildings, increase allowable ADU square <br />footage, limit restrictions on lot size, lot coverage, floor area, and open space, and prohibit short term <br />rentals of ADUs.
