Code § <br />27383. <br />SUBDIVISION IMPROVEMENT AGREEMENT <br />910 Woodside Road <br />THIS SUBDIVISION IMPROVEMENT AGREEMENT ("Agreement") is made and <br />entered into on this day of February 10, 2020 ("Effective Date") by and between Valera <br />Fooksman, an individual ("Developer"), and the CITY OF REDWOOD CITY, a charter <br />city and California municipal corporation ("City") (together, the "Parties") with reference to <br />the following facts: <br />RECITALS <br />A. Developer is the current fee owner of that certain real property consisting of <br />approximately 0.31 acres located within the City of Redwood City, County of San Mateo, <br />State of California, described in Exhibit "A", attached hereto and incorporated herein by <br />reference (the "Property"). <br />B. On October 15, 2019, the Planning Commission of the City of Redwood City <br />adopted, among other approvals, Resolution No. 19-16, approving the Tentative Map for <br />910 Woodside ("Project"), prepared by DMG Engineering, Inc. and dated July 111, 2016 <br />("Tentative Map"), subject to certain conditions of approval ("Conditions"). <br />C. The Conditions require either (1) that certain public improvements for the <br />Project be constructed prior to approval of the final map ("Final Map"), or (2) that <br />Developer enter into an agreement with City providing for the future construction of such <br />public improvements. <br />D. Developer has submitted the Final Map and applied to City for Final Map <br />approval without having completed the required public improvements and, therefore, will <br />enter into an agreement with City providing for the future construction and installation of <br />such public improvements, as required by Government Code section 66462(a) (1). <br />E. Developer has submitted to City plans, specifications and drawings entitled <br />On -Site and Off -Site Improvement Plans 910 Woodside Road, prepared by MacLeod and <br />Associates and dated January 17, 2020 (the "Improvement Plans"), which, in addition to <br />other improvements, provide for certain on-site public improvements consisting of street <br />and street light improvements, storm drain systems, domestic water systems and sanitary <br />sewer systems for the Project (collectively, "Improvements"). <br />REV: 01-24-20 PR <br />ATTY/AGR.2020.014/Valera Fooksman (Page 1 of 22) <br />140 <br />
