DES:rg 0''25/95 (111/34) <br /> <br />(the "Subject Lands") more particularly described in Exhibit "A" <br />hereof, and depicted upon the plat designated Exhibit "B" hereof, <br />which exhibits are attached hereto and by this reference <br />incorporated herein; and <br /> <br /> WHEREAS, pursuant to Resolution No. SBSA 93-56 entitled, <br />"Resolution Consenting to Proposed Sale of Sanitary Sewerage <br />Treatment Capacity Rights (Rohm and Haas, California, Inc./Pacific <br />Shores Center Limited Partnership)," adopted December 22, 1993, by <br />the Commission of South Bayside System Authority, a joint exercise <br />of powers authority of which this City is a member agency, said <br />Authority consented to the transfer from R & H to PSCL of 0.20 <br />millions of gallons per day ("mgd") Capacity Rights pursuant to the <br />provisions of paragraph 3 (c) of the Agreement, with the proviso <br />that said consent shall not be deemed a limitation upon any <br />regulatory authority or other appropriate exercise of jurisdiction <br />by said Authority or any of its member agencies with respect to the <br />use of said sanitary sewerage capacity rights or facilities or <br />activities in connection therewith; and <br /> <br /> WHEREAS, pursuant to the provisions of paragraph 3(c) of the <br />Agreement, R & H seeks consent of this Council to the conveyance of <br />a portion of its non-grant eligible treatment capacity rights under <br /> <br /> the R & H/PSCL Agreement; <br /> NOW, THEREFORE; <br /> <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY, <br /> <br /> AS FOLLOWS: <br /> <br /> 1.
