6.H. - Page 4 of 24 <br />ORDINANCE NO. <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />REDWOOD CITY AMENDING CHAPTER 27 OF THE REDWOOD <br />CITY MUNICIPAL CODE TO ADOPT A FATS, OILS, AND GREASE <br />CONTROL PROGRAM AND TO ADD ENFORCEMENT PENALTIES <br />WHEREAS, the State Water Resources Control Board adopted a Statewide <br />Sanitary Sewer Order in May 2006 to address the issue of Sewer System Overflows <br />throughout the State; and <br />WHEREAS, the Statewide Sanitary Sewer Order requires agencies to <br />develop and implement a Sewer System Management Plan that documents the <br />actions an agency is taking to properly operate and maintain its sewer system in <br />order to reduce sewer system overflows; and <br />WHEREAS, one of the requirements of a Sewer System Management Plan is <br />a Fats, Oils, and Grease ("FOG") Control Plan; and <br />WHEREAS, fats, oils, and grease are a major contributor to sewer system <br />overflows; and <br />WHEREAS, the City of Redwood City ("City") is desirous of reducing the <br />discharge of fats, oils, and grease in the City, as untreated sewage can pollute <br />surface and ground waters, threaten public health, adversely affect aquatic life and <br />impair the recreation use of surface waters; and <br />WHEREAS, the purpose of this Ordinance is to regulate the intrusion of fats, <br />oils, and grease into the City's sewerage system in order to prevent sanitary sewer <br />blockages and obstructions, and to provide for enforcement against those persons <br />and establishments, particularly food preparation and serving establishments, that <br />discharge such substances into the sanitary sewer; and <br />WHEREAS, it is necessary to establish uniform requirements to prevent the <br />discharge of fats, oils, and grease into the sewerage facilities used jointly with other <br />public entities as a party to the joint exercise of powers agreement establishing and <br />providing for Silicon Valley Clean Water, a publicly owned treatment works and any <br />successor thereto; and <br />WHEREAS, the health, safety and welfare of the public require the enactment <br />of this Ordinance to govern sewer use in order to protect the sanitary sewer system <br />from damage, and to control the discharge of fats, oils, and grease thereto. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDWOOD <br />CITY DOES ORDAIN AS FOLLOWS: <br />Section 1.
