Section 2. This proposed Ordinance has been reviewed with respect to applicability of the California Environmental Quality Act ("CEQA") and the State CEQA Guidelines (California Code of Regulations, Title 14, Sections 15000 et seq.). The Ordinance is not a project pursuant to CEQA Guidelines, Section 15378(b) (2), because it is an administrative activity. Even if the Ordinance were to be considered a project, it would be categorically exempt pursuant to CEQA Guidelines, Section 15308, because it sets forth regulations to prevent FOG from entering the City's sewerage system and waterways. Thus, this Ordinance is an action taken by a regulatory agency to maintain and protect the environment. Section 3. If any section, subsection, clause or phrase of this Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portion or sections of the Ordinance. The City Council of the City of Redwood City hereby declares that it would have adopted the Ordinance and each section, subsection, sentence, clause or phrase thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared unconstitutional. Section 4. The City Council of the City of Redwood City adopts the amendment to Section 27.3 of the Redwood City Municipal Code, by adding the text shown in underline (example) and deleting the text shown in strikeout (example), as shown in Exhibit A, which is attached hereto and incorporated herein by reference. The City Council of the City of Redwood City adopts the amendment to Article VIII of Chapter 27 of the Redwood City Municipal Code by deleting it in its entirety and adding a new Article VIII, consisting of Sections 27.90 through 27.99, as shown in Exhibit B, which is attached hereto and incorporated herein by reference. The City Council of the City of Redwood City adopts the amendment to Article XI of Chapter 27 of the Redwood City Municipal Code by deleting it in its entirety and adding a new Article XI, consisting of Sections 27.120 through 27.138, as shown in Exhibit C, which is attached hereto and incorporated herein by reference.
