Code § <br />27383. <br />SUBDIVISION IMPROVEMENT AGREEMENT <br />353 Main Street <br />THIS SUBDIVISION IMPROVEMENT AGREEMENT ("Agreement") is made and <br />entered Into on this day of , 20_ ("Effective Date") by and between353 <br />Main Street Apartments, LP, a California limited partnership ("Developer"), and the CITY <br />OF REDWOOD CITY, a charter city and California municipal corporation ("City") <br />(together, the "Parties") with reference to the following facts: <br />RECITALS <br />A. Developer is the current fee owner of that certain real property consisting of <br />approximately 1.85 acres located within the City of Redwood City, County of San Mateo, <br />State of California, described in Exhibit "A", attached hereto and incorporated herein by <br />reference (the "Property"). <br />B. On May 21, 2018, the , City Council of the City of Redwood City adopted, <br />among other approvals, Resolution No. 15665, approving a Planned Community Permit <br />and other entitlements for 353 Main Street ("Project"), subject to certain conditions of <br />approval ("Conditions"). <br />C. The Conditions require either (1) that certain public improvements for the <br />Project be constructed prior to approval of the Building Permit, or (2) that Developer enter <br />into an agreement with City providing for the future construction of such public <br />improvements. <br />D. Developer has submitted the Improvement Plans and applied to City for <br />Building Permit approval without having completed the required public improvements and, <br />therefore, will enter into an agreement with City providing for the future construction and <br />installation of such public improvements. <br />E. Developer has submitted to City plans, specifications and drawings entitled <br />Offsite Improvement Plans of 353 Main Street, prepared by Kier & Wright Civil Engineers <br />& Surveyors, Inc. and dated , 20_ (the "Improvement Plans"), which, in <br />addition to other improvements, provide for certain on-site public improvements <br />consisting of street and street light improvements, storm drain systems, domestic water <br />systems and sanitary sewer systems for the Project (collectively, "Improvements"). <br />REV: 12-16-19 PR <br />ATTY)AGR.2019.315IWoodsfde Professional Center, LLC (Page 1 of 22) 167 <br />
