6.B. - Page 3 of 13 <br />ENVIRONMENTAL REVIEW <br />This activity is not a project under California Environmental Quality Act (CEQA) as defined in CEQA <br />Guidelines, section 15378, because it has no potential for resulting in either a direct or reasonably <br />foreseeable indirect physical change in the environment. <br />PUBLIC NOTICE <br />Public notification was achieved by posting the agenda, with the agenda items being listed, at least 72 <br />hours prior to the meeting. <br />ALTERNATIVES <br />City Council may elect to not execute an MOU with WETA for the Feasibility and Business Plan Phases, and <br />instead direct staff to work with WETA on an MOU for future phases of the Ferry Project. The Study would <br />not be impacted by the failure to execute an MOU since the Study is currently underway and there is no <br />financial commitment from WETA identified in the MOU. The Study is fully funded by the SMCTA and City. <br />Regardless of whether there is an MOU for these phases, the Study is necessary for the City Council to <br />determine whether the project is viable. The Study is also necessary to acquire additional Measure A <br />funding towards a ferry project. Moreover, WETA requires new projects be feasible in order for them to <br />be incorporated into the WETA system, so if the City did intend to have a terminal as part of the WETA <br />system, the City would have needed to complete a feasibility study. <br />Another alternative would be to not pursue an MOU for any phase.
