Code §27383 <br />LANDSCAPE MAINTENANCE AGREEMENT <br />353 Main Street <br />THIS LANDSCAPE MAINTENANCE <br />entered into this day of <br />353 Main Street Apartments, LP, a Californ <br />CITY OF REDWOOD CITY, a charter city <br />with reference to the following facts: <br />AGREEMENT ("Agreement") is made and <br />20 ("`Effective Date"), by and between <br />a limited partnership ("Developer"), and the <br />nd California municipal corporation ("City") <br />RECITALS <br />A. Reference is made to that certain real property situated in the City of <br />Redwood City, County of San Mateo, State of California, known as 353 Main Street <br />("Site") and described on Exhibit "A", attached hereto and incorporated by this reference <br />as if fully set forth herein (the "Property"). The Property is being developed as a <br />residential project. <br />B. In connection with its development of the Property as an residential <br />apartment project, Developer submitted to City Offsite Improvement Plans of 353 Main <br />Street, which include, inter glia, landscaping plans for along the Property frontage <br />("Plans"), all of which Plans have been approved by City. The Plans provide for <br />installation of certain landscaping, pedestrian lighting, pedestrian paving, and irrigation <br />("Improvements") within Main Street ("Maintenance Area") as the Improvements and <br />Maintenance Area are more specifically shown on Exhibit "B" attached hereto and <br />incorporated by this reference as if fully set forth herein. <br />C. City and Developer desire to enter into an agreement pursuant to which <br />Developer will maintain the Improvements within the Maintenance Area as both are <br />depicted on Exhibit "B". <br />AGREEMENT <br />NOW, THEREFORE, City and Developer (together, the "Parties") hereby agree as <br />follows: <br />1. PURPOSE OF AGREEMENT.
