Code § <br />27383. <br />SUBDIVISION IMPROVEMENT AGREEMENT <br />49 Orchard Avenue <br />THIS SUBDIVISION IMPROVEMENT AGREEMENT ("Agreement") is made and <br />entered into on this day of , 2020 ("Effective Date") by and between 49 <br />Orchard LLC, a California limited liability.company ("Developer"), and the CITY OF <br />REDWOOD CITY, a charter city and California municipal corporation ("City") (together, <br />the "Parties") with reference to the following facts: <br />RECITALS <br />A. Developer is the current fee owner of that certain real property consisting of <br />approximately 0.36 acres located within the City of Redwood City, County of San Mateo, <br />State of California, described in Exhibit "A", attached hereto and incorporated herein by <br />reference (the "Property"). <br />B. On July 28, 2017, the Subdivision Committee of the City of Redwood City <br />approved the Tentative Map for the 49 Orchard Avenue ("Project"), prepared by C&DC, <br />Inc. and dated June 2017 ("Tentative Map"), subject to certain conditions of approval <br />("Conditions"). This approval was extended by the Acting Community Development <br />Director on July 17, 2019. <br />C. The Conditions require either (1) that certain public improvements for the <br />Project be constructed prior to approval of the parcel map ("Parcel Map"), or (2) that <br />Developer enter into an agreement with City providing for the future construction of such <br />public improvements. <br />D. Developer has submitted the Parcel Map and applied to City for Parcel Map <br />approval without having completed the required public improvements and, therefore, will <br />enter into an agreement with City providing for the future construction and installation of <br />such public improvements, as required by Government Code section 66411.1. <br />E. Developer has submitted to City plans, specifications and drawings entitled <br />49 Orchard Ave Improvement Plans, prepared by LC Engineering and dated <br />20 (the "Improvement Plans"), which, in addition to other <br />improvements, provide for certain on-site public improvements consisting of street and <br />REV: 01-09-20 PR <br />ATTYIAGR.2020.002149 Orchard (Page 1 of 22) 74 <br />
