6.C. - Page 2 of 57 The developer provided a faithful performance bond and a labor and material bond, each in the amount of $1,539,713 that may now be released in accordance with the timing described in the Improvement Agreement. The Developer is responsible for the maintenance of the frontage improvements including sidewalk, curb, and gutter, street trees, irrigation, pedestrian scale street lighting through the Landscape Maintenance Agreement. The Developer is also responsible for the maintenance of stormwater treatment measures through the Stormwater Treatment Measures Maintenance Agreement. FISCAL IMPACT There is no fiscal impact to the City as a result of this action. ENVIRONMENTAL REVIEW This action does not constitute a project as defined by the California Environmental Quality Act because the release of bonds and acceptance of completed improvements will not result in a direct or reasonably foreseeable indirect physical change in the environment. On October 14, 2014, the Planning Commission considered an Initial Study Checklist and made findings that the Checklist was completed in compliance with the California Environmental Quality Act. The Commission also determined that there was no substantial evidence that the Project would result in new environmental impacts beyond those previously identified in the Downtown Precise Plan Environmental Impact Report. PUBLIC NOTICE Public notification was achieved by posting the agenda, with the agenda items being listed, at least 72 hours prior to the meeting. ALTERNATIVES The City Council may choose not to accept the construction improvements and release bonds, however, this would not be in accordance with the provisions in the signed Agreement.
