6.C. - Page 2 of 57 <br />The developer provided a faithful performance bond and a labor and material bond, each in the amount <br />of $1,539,713 that may now be released in accordance with the timing described in the Improvement <br />Agreement. <br />The Developer is responsible for the maintenance of the frontage improvements including sidewalk, curb, <br />and gutter, street trees, irrigation, pedestrian scale street lighting through the Landscape Maintenance <br />Agreement. The Developer is also responsible for the maintenance of stormwater treatment measures <br />through the Stormwater Treatment Measures Maintenance Agreement. <br />FISCAL IMPACT <br />There is no fiscal impact to the City as a result of this action. <br />ENVIRONMENTAL REVIEW <br />This action does not constitute a project as defined by the California Environmental Quality Act because <br />the release of bonds and acceptance of completed improvements will not result in a direct or reasonably <br />foreseeable indirect physical change in the environment. <br />On October 14, 2014, the Planning Commission considered an Initial Study Checklist and made findings <br />that the Checklist was completed in compliance with the California Environmental Quality Act. The <br />Commission also determined that there was no substantial evidence that the Project would result in new <br />environmental impacts beyond those previously identified in the Downtown Precise Plan Environmental <br />Impact Report. <br />PUBLIC NOTICE <br />Public notification was achieved by posting the agenda, with the agenda items being listed, at least 72 <br />hours prior to the meeting. <br />ALTERNATIVES <br />The City Council may choose not to accept the construction improvements and release bonds, <br />however, this would not be in accordance with the provisions in the signed Agreement. <br />ATTACHMENTS <br />Attachment A — Improvement Agreement <br />Attachment B — Project Location Map <br />Page 2 of 3 <br />City of Redwood City 1017 Middlefield Road, Redwood City, CA. 94063 Tel: 650-780-7000 www.redwoodcity.ore <br />
