05/04/2020 <br />E. Other. Competitive Bidding Processes may be dispensed with in accordance with any other <br />Section of the City Charter or this Article that provides such an exemption (e.g. highly <br />specialized Professional Services exemption under Section 2.66.2). <br />F. Purchases Not Susceptible to Competitive Bidding Process. Except where otherwise required <br />by federal law or by reason of the source of funding for the project, Goods and Services may <br />be obtained without a Competitive Bidding Process where such purchases are not readily <br />adaptable to the open market and bidding processes. Such purchases include, but shall not <br />be limited to: (1) utility services (telephone, gas, water, sewer and electricity) provided to City <br />buildings and facilities, (2) franchises awarded by the City Council, (3) insurance or bond <br />premiums, and (4) subscriptions, memberships, software licenses, advertisements and travel <br />expenses. <br />Sec. 2.67.5. IMPROVEMENT ACT: <br />Whenever any Public Works Project is to be constructed pursuant to any improvement ordinance <br />or State Improvement Act, competitive processes provided for therein shall control over any <br />inconsistent provisions of this Article. <br />Sec. 2.67.6. ASSESSMENT DISTRICT FORMATION: <br />A. The City Manager is hereby authorized and directed to procure in accordance with this Article, <br />expert personal services of engineering, appraisal, right-of-way acquisition, and legal nature, <br />to the extent that such services are necessary or convenient to the formation and completion <br />of such local special assessment districts as are authorized to be instituted by the City Council <br />and to the extent that unencumbered funds are available therefor. <br />B. The City Manager is hereby authorized and directed to acquire property necessary or <br />convenient for the completion of Public Works Projects within such local public assessment <br />districts as are authorized to be instituted by the City Council, and to the extent that <br />unencumbered funds are available therefor. <br />Sec. 2.68. through Sec. 2.84. RESERVED: <br />Section 5. This ordinance is not a "project' within the meaning of the California <br />Environmental Quality Act (CEQA) because it involves organizational or administrative activities <br />of the City that will not result in direct or indirect physical changes in the environment. (CEQA <br />Guidelines § 15378(b)(5)). <br />Section 6. If any section, subsection, subdivision, paragraph, sentence, clause or <br />phrase of this Ordinance, or its application to any person or circumstance, is for any reason held <br />to be invalid or unenforceable, such invalidity or unenforceability shall not affect the validity or <br />enforceability of the remaining sections, subsections, subdivisions, paragraphs, sentences, <br />clauses or phrases of this Ordinance, or its application to any other person or circumstance. The <br />City Council of the City of Redwood City hereby declares that it would have adopted each section, <br />subsection, subdivision, paragraph, sentence, clause or phrase hereof, irrespective of the fact <br />that any one or more other sections, subsections, subdivisions, paragraphs, sentences, clauses <br />or phrases hereof is declared invalid or unenforceable. <br />Section 7.
