05/04/2020 <br />D. The City Manager is authorized to delegate, in writing, authority to approve any and all <br />Contracts in an amount of Twenty Five Thousand Dollars ($25,000) or less. This amount shall <br />increase annually by the Consumer Price Index for San Francisco -Oakland -San Jose (or its <br />successor index) as published by the U.S. Department of Labor or its successor agency, <br />capped at two (2) percent and rounded to the nearest hundred, or Five Hundred Dollars <br />($500), whichever amount is lower; but in no event shall the amount decrease. <br />Sec. 2.63.5. DETERMINATION OF LOWEST RESPONSIVE AND RESPONSIBLE BIDDER: <br />The City shall award Contracts required for Public Works Projects and Goods and Services to the <br />lowest responsive and responsible Bidder. A responsive Bidder will have submitted a Bid that <br />conform in all material respects to requirements of the Bid documents. In determining the lowest <br />responsible Bidder, the following factors may be considered in addition to price: <br />A. The ability, capacity and skill of the Bidder to perform the Contract or provide the service <br />required. <br />B. The character, integrity, reputation, judgment, experience and efficiency of the Bidder. <br />C. The quality of performance of previous Contracts or services for the City or other contracting <br />parties. <br />D. The previous and existing compliance by the Bidder with the laws and ordinances relating to <br />a Contract or service. <br />E. The sufficiency of the financial resources and ability of the Bidder to perform the Contract or <br />provide the services. <br />F. The ability of the Bidder to provide future maintenance and service for the use of the subject <br />of the Contract. <br />G. Schedule and ability to meet the City's time constraints. <br />H. Any other criteria appropriate for the type of Contract to be awarded. <br />Sec. 2.63.6. CONTRACT PRICE: <br />A. Whenever a Contract estimated, cost or Contract price is referred to in this Article, for the <br />purpose of determining the appropriate purchasing procedure, that cost or price excludes <br />sales tax and freight. <br />B. No Contract shall be subdivided or separated into two or more Contracts to avoid the <br />requirements of this Article. <br />Sec. 2.63.7. WRITTEN CONTRACTS: <br />A. No Contract shall be required for the procurement of Goods and Services valued at Ten <br />Thousand Dollars ($10,000) or less. <br />B. All Contracts entered into by the City pursuant to this Article shall be in writing and shall be <br />executed by the City Manager or other duly authorized officer of the City. <br />C.
