Eighty percent of young people who have ever used <br />tobacco started with a flavored product. <br />SB 793 prohibits a tobacco retailer, or any of the tobacco retailer's agents or employees, from selling, <br />offering for sale, or possessing with the intent to sell or offer for sale a flavored tobacco product or a <br />tobacco product flavor enhancer. <br />Specifically, this Bill: <br />• Prohibits a tobacco retailer, or any of the tobacco retailer's agents or employees, from selling, <br />offering for sale, or possessing with the intent to sell or offer for sale a flavored tobacco product <br />or a tobacco product flavor enhancer. <br />• Deems a tobacco product as a flavored tobacco product if a manufacturer or any of the <br />manufacturer's agents or employees, in the course of his or her agency or employment, has made <br />a statement or claim directed to consumers or to the public that the tobacco product has or <br />produces a "characterizing flavor," as defined, including, but not limited to, text, color, images, or <br />all, on the product's labeling or packaging that are used to explicitly or implicitly communicate <br />that the tobacco product has a characterizing flavor. <br />• Deems it an infraction if a tobacco retailer, or agent or employee of a tobacco retailer, violates <br />the provisions of this bill, and imposes a fine of $250 for each violation. <br />• Specifies that the provisions in this bill do not preempt or prohibit the adoption of local standards <br />that impose a greater restriction on the access of tobacco products than the provisions in this bill. <br />Requires the greater restriction on the access of tobacco products to prevail in the case of <br />inconsistency between the provisions of this bill and local standards. <br />Bill Status: <br />The Bill has been set for a hearing on June 1, 2020 as of May 26, 2020. <br />Redwood City Legislative Platform <br />SB 793 (Hill) falls in line with the "Children and Youth" section of the Redwood City adopted legislative <br />platform. <br />• Specifically: "Support legislation that promotes youth wellbeing and school safety." <br />Background SB 1441 (McGuire): <br />In 2014, the Legislature enacted the Prepaid Mobile Telephony Services Surcharge Collections Act, which <br />required sellers of prepaid wireless telecommunications services to collect a fee measured as a <br />percentage of the sales price, known as the Mobile Telephony Services (MTS) fee (AB 1717, Perea).
