<br />Such insurance shall also specifically insure any contractual liability assumed by <br /> <br />Owner under the terms of this Agreement, including, but not limited to, the provisions of <br /> <br />Paragraph 1 above. <br /> <br />5. <br /> <br />MONUMENTS. <br /> <br />All pipes and monuments shown on the subdivision <br /> <br />map hereinafter referenced which are destroyed or displaced during construction <br /> <br />operations shall be replaced by Owner at the time of the final inspection of the <br /> <br />Improvements, if any, hereunder by City. <br /> <br />6. <br /> <br />OWNERSHIP OF IMPROVEMENTS. <br /> <br />It is agreed that title and <br /> <br />ownership of all Improvements constructed for the benefit of City hereunder by Owner <br /> <br />shall vest absolutely in City upon completion and acceptance of such Improvements by <br /> <br />City. <br /> <br />7. WORK SUBJECT TO APPROVAL. All work provided for in this <br /> <br />Agreement and more specifically described in the plans and specifications herein <br /> <br />referenced shall be subject to the approval and acceptance by the City Engineer before <br /> <br />the release of any security required herein. Reference is hereby made to (a) that certain <br /> <br />final map entitled, "Lincoln Avenue Townhomes Subdivision", (b) those certain plans on <br /> <br />file in the office of the City Engineer entitled, "Improvement Plans - Lands of Peninsula <br /> <br />Habitat for Humanity, 122-136 Lincoln Avenue", and (c) those certain revised <br /> <br />specifications entitled, "Engineering Standards for the City of Redwood City", adopted <br /> <br />December 4, 2006, for a more particular description of the work and Improvements <br /> <br />generally described in this Agreement. Said final map, plans and specifications <br /> <br />referenced in this paragraph are hereby incorporated herein and made a part of this <br /> <br />Agreement. Upon completion of the aforementioned work, and prior to the release of <br /> <br />any security required herein, Owner shall furnish City with a complete set of plans and <br /> <br />drawings showing the Improvements in their actual or "as-built" condition and location. <br /> <br />ATTY/AGR/2008.001 <br />1nJ08 <br /> <br />6 <br />
