06/08/2020 <br />RESOLUTION NO. 15846 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD <br />CITY SUMMARILY VACATING A PUBLIC UTILITY EASEMENT <br />LOCATED ON THE PROPERTY AT 353 MAIN STREET <br />WHEREAS, pursuant to the provisions of Chapter 4, Part 3 (commencing at <br />Section 8330) of Division 9 of the California Streets and Highways Code, the City <br />Council ("City Council") of the City of Redwood City ("City") may summarily vacate <br />public service easements, if such easements are superseded by relocation and there <br />are no other public service facilities located within the easement; and <br />WHEREAS, the City Council intends to summarily vacate the public utility <br />easement located at 353 Main Street as shown on the Parcel Map No. 78-8 in Volume <br />44 of Parcel Maps, at Pages 26 in the office of the Recorder for the County of San <br />Mateo, and as described and depicted in Exhibit A and Exhibit B, attached hereto and <br />incorporated by reference ("Vacation Area"); and <br />WHEREAS, the property owner (353 Main Street Apartments, LP) proposes to <br />relocate the existing sanitary sewer main located in the Vacation Area; and <br />WHEREAS, 353 Main Street Apartments, LP proposes to offer for dedication to <br />the City a public utility easement described and depicted in Exhibit C and Exhibit D, <br />attached hereto and incorporated by reference, in exchange for the public service <br />easement to be vacated; and <br />WHEREAS, upon the City's acceptance and recordation of the new public <br />service easement offered for dedication, and relocation of the existing sanitary sewer <br />main described above, the Vacation Area will be superseded by relocation pursuant to <br />Streets and Highways Code Section 8333. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF REDWOOD CITY AS FOLLOWS: <br />1. The recitals set forth above are true and correct, and are hereby incorporated <br />herein by this reference as if fully set forth in their entirety. <br />2. The easement located in the Vacation Area described and depicted in Exhibit <br />A and Exhibit B will be superseded by relocation. <br />3. There are no other public service facilities located within the Vacation Area. <br />4. The public utility easement located in the Vacation Area described and <br />depicted in Exhibit A and Exhibit B is hereby ordered vacated, subject to the following <br />conditions being met to the satisfaction of the City Engineer: <br />ATTY/RE50.0013/CC RESO VACATING PUBLIC UTILITY EASEMENT -353 MAIN ST RE50.
