06/22/2020 <br />rules and regulations must be confirmed by the City Council at the earliest practicable <br />time; and <br />WHEREAS, the City Manager is also empowered, as the Director of Emergency <br />Services, to execute all ordinary powers as City Manager, all the special powers conferred <br />upon him by any statute or agreement approved by the City Council or by any other lawful <br />authority, and, in conformity with the provisions of Government Code Section 38791, to <br />exercise complete authority over the City and all police powers vested in the City by the <br />California Constitution and general laws of the State; and <br />WHEREAS, on June 15, 2020 at 4:29 p.m., the City Manager, in her capacity as <br />Director of Emergency Services, signed a Proclamation pursuant to City Code section <br />10.6(B), in the interest of public health and safety, as affected by the emergency caused <br />by the spread of COVID-19. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF REDWOOD CITY AS FOLLOWS: <br />SECTION 1. The above recitals are accurate, constitute findings in this matter, <br />and are hereby incorporated into this reference. <br />SECTION 2. This activity is not a project under California Environmental Quality <br />Act (CEQA) as defined in CEQA Guidelines Section 15378, because it has no potential <br />for resulting in either a direct or reasonably foreseeable indirect physical change in the <br />environment. Similarly, the proposed activity falls within the scope of CEQA Guidelines <br />Section 15061(b)(3), in that it can be seen with certainty that there is no possibility that <br />the activity in question, namely outdoor dining on public and private property, will have a <br />significant effect on the environment. Separately and independently, even if the activity <br />constituted a project under CEQA, it would be exempt as set forth in CEQA Guidelines <br />Section 15304, because the use of existing streets, sidewalks and private property for <br />outdoor dining constitutes a minor temporary use of land having negligible or no <br />permanent effects on the environment. <br />ATTY/RESO.0054/CC RESO RATIFYING A PROCLAMATION APPROVING OUTDOOR DINING RESO.
