"Redwood City Improvement Association". RCIA shall take care not to convey that it is a <br />government agency or that it is the "Downtown Redwood City Community Benefit <br />Improvement District", rather than the owners association and/or manager of the District. <br />Any uniform worn by RCIA personnel or contractors that includes the word "District" must <br />also include the name "Redwood City Improvement Association" in a font no less than <br />three quarters the size of the word "District." <br />4.6. Reportin _ to o Property Owners within the District. A statement of activities/programs funded <br />by District Revenues, and the cost of each such activity or program shall be mailed to every <br />property owner within the District by December 31 st of each year during the Term (the <br />"Activity Statement"). A copy of the Activity Statement and a list of property owner names <br />and addresses shall be provided to the City no later than December 15th of each year during <br />the Term. <br />4.7. Open Meetings Laws and Public Records. RCIA is an "owners' association" as that term is <br />used in Section 36612 of the Streets and Highways Code. RCIA shall comply with the <br />Ralph M. Brown Act (Chapter 9 (commencing with Section 54950) of Part 1 of Division 2 <br />of Title 5 of the Government Code), at all times when matters within the subject matter of <br />the District are heard, discussed, or deliberated, and with the California Public Records Act <br />(Chapter 3.5 (commencing with Section 6250) of Division 7 of Title 1 of the Government <br />Code), for all documents relating to activities of the District. <br />4.8. Program and Budget Reports. <br />4.8.1. Reports, Work Plans and Budgets. On or before September 30, 2020 and quarterly <br />thereafter, the RCIA shall submit quarterly reports to the City. Copies of Board <br />minutes and meeting notes should suffice in lieu of any quarterly report. In addition, <br />RCIA shall also submit an Annual Work Plan and Budget on or before November 30th <br />for each fiscal year for which Assessments are to be levied and collected (the "Annual <br />Report and Budget"). The Annual Work Plan and Budget shall be prepared in <br />accordance with Sections 36622 and 36650 of the Streets and Highways Code, and <br />Article XIII D of the California Constitution. If changes to the Annual Work Plan <br />and/or Budget are requested that would require a public hearing and/or a public <br />meeting pursuant to state law, the Community Benefit Improvement District <br />Ordinance, or which would affect the Assessment database and resulting budget of <br />the upcoming fiscal year, then such modification shall be submitted prior to May 1St <br />of each year. The City must report any changes to the database or boundaries to the <br />County by July 15th of each year during the Term. The Budget for any year shall not <br />be effective until approved by the City. <br />4.8.2. Budget. Each program or activity specified in the District Plan and succeeding <br />programs and activities shall be implemented within the approved budget amounts in <br />accordance with the District Plan and this Agreement.
