When Recorded Mail To: <br />Tranente One LLC <br />429 Llewellyn Avenue <br />Campbell, CA 95008 <br />With a Copy To: <br />City of Redwood City <br />1017 Middlefield Road <br />Redwood City, CA 94063 <br />Attn: City Clerk <br />APNs. 054-081-010 and 054-081-140 <br />COVENANT FOR NO BUILD EASEMENT <br />This COVENANT FOR NO BUILD EASEMENT ("Covenant") is made and entered into <br />on this 7-t� day of _ J -,!: t , 2020, by and among TRANENTE ONE LLC, a <br />California limited liability company, (hereinafter referred to as "Tranente"), and the City of <br />Redwood City, a charter city and municipal corporation (hereinafter referred to as the "City"). <br />Tranente and City are sometimes hereinafter referred to individually as "Party" and collectively <br />as "Parties". <br />Recitals <br />A. Tranente is the owner of certain real property located in the City of Redwood City, <br />County of San Mateo, State of California, commonly known as 860 Charter Street, Assessor's <br />Parcel Number 054-081-140, and more particularly described on Exhibit A attached hereto and <br />made a part hereof (hereinafter referred to as "Parcel One"). <br />B. Tranente is also the owner of certain real property located in the County of San <br />Mateo, State of California, Assessor's Parcel Number, 054-081-010, and more particularly <br />described in Exhibit B attached hereto and made a part hereof (hereinafter referred to as "Parcel <br />Two"). <br />C. On or about r �,iY) e, 'L) , 2020, the City approved a building permit <br />CT <br />("Permit") to allow construction of a kitchen ("Project"), subject to the recordation of the Parcel <br />Two No Build Easement (as defined in Section 2 below). <br />D. To facilitate Tranente's intended building design and to comply with applicable <br />fire, building, and other codes and regulations, the City requires, and Tranente proposes to <br />maintain, a no build (negative) easement area on that portion of Parcel Two identified as a "No <br />Build Easement" legally described on Exhibit C-1 and shown on the plat attached hereto as <br />Exhibit C-2, both of which are attached hereto and made a part hereof (the "Parcel Two No Build <br />REV: 05-08-2020 PR <br />ATTY/AGR.2020.072/TRANENTE ONE LLC (Page 1 of 10) <br />
