6.D. - Page 2 of 26 ANALYSIS The developer, SummerHill 150 ECR, LLC, has completed the construction of improvements in accordance with the Agreement, the plans and specifications, the conditions of approval, and to the satisfaction of the City's Engineering Division. The developer provided a faithful performance bond and a labor and material bond, each in the amount of $859,899.00 that may now be released in accordance with the timing described in the Improvement Agreement. The Developer is responsible for the maintenance of the frontage improvements including sidewalk, curb, and gutter, street trees, irrigation, pedestrian scale street lighting through the Landscape Maintenance Agreement. The Developer is also responsible for the maintenance of on-site stormwater treatment measures through the Stormwater Treatment Measures Maintenance Agreement. FISCAL IMPACT There is no fiscal impact to the City as a result of this action. ENVIRONMENTAL REVIEW This action does not constitute a project as defined by the California Environmental Quality Act because the release of bonds and acceptance of completed improvements will not result in a direct or reasonably foreseeable indirect physical change in the environment. On June 23, 2015, the Planning Commission made findings that the project was exempt from the California Environmental Quality Act pursuant to Section 15332 "In -Fill Development Projects." PUBLIC NOTICE Public notification was achieved by posting the agenda, with the agenda items being listed, at least 72 hours prior to the meeting. ALTERNATIVES The City Council may choose not to accept the construction improvements and release bonds. However, this would not be in accordance with the provisions in the signed Agreement.
