6.D. - Page 2 of 26 <br />ANALYSIS <br />The developer, SummerHill 150 ECR, LLC, has completed the construction of improvements in accordance <br />with the Agreement, the plans and specifications, the conditions of approval, and to the satisfaction of <br />the City's Engineering Division. <br />The developer provided a faithful performance bond and a labor and material bond, each in the amount <br />of $859,899.00 that may now be released in accordance with the timing described in the Improvement <br />Agreement. <br />The Developer is responsible for the maintenance of the frontage improvements including sidewalk, curb, <br />and gutter, street trees, irrigation, pedestrian scale street lighting through the Landscape Maintenance <br />Agreement. The Developer is also responsible for the maintenance of on-site stormwater treatment <br />measures through the Stormwater Treatment Measures Maintenance Agreement. <br />FISCAL IMPACT <br />There is no fiscal impact to the City as a result of this action. <br />ENVIRONMENTAL REVIEW <br />This action does not constitute a project as defined by the California Environmental Quality Act because <br />the release of bonds and acceptance of completed improvements will not result in a direct or reasonably <br />foreseeable indirect physical change in the environment. <br />On June 23, 2015, the Planning Commission made findings that the project was exempt from the California <br />Environmental Quality Act pursuant to Section 15332 "In -Fill Development Projects." <br />PUBLIC NOTICE <br />Public notification was achieved by posting the agenda, with the agenda items being listed, at least 72 <br />hours prior to the meeting. <br />ALTERNATIVES <br />The City Council may choose not to accept the construction improvements and release bonds.
