Code § 27383. <br />IMPROVEMENT AGREEMENT <br />150 EI Camino Real <br />T ISYIROVEMEP'T AGREEMENT ("Agreement") is made and entered into on this /fday <br />of , 20("Effective Date") by and between by and between SummerHill 150 <br />ECRL , a Cal fornia li rted liability compan ("Developer"), and the CITY OF REDWOOD <br />CITY, a Ichartel city and California municipal corporation ("City") with reference to the <br />facts: <br />RECITALS <br />A . I Developer is the current fee owner of that certain real property consisting of <br />approximately 0.44 acres located within the City of Redwood City, County of San Mateo, State of <br />California, described in Exhibit A, attached hereto and incorporated herein by reference (the "Property"). <br />B. On June 23, 2015, the Planning Commission of the City of Redwood City adopted, <br />among other approvals, Resolution No. 15-1.1, approving the Vesting Tentative Map for the 150 El <br />Camino and 20 Avondale ("Project"), prepared by BKF Engineers and dated June 10, 2015 ("Tentative <br />Map"), subject to certain conditions of approval ("Conditions"). <br />C . The Conditions require either (1) that certain public improvements for the Project be <br />constructed prior to approval of the jIggl reap ("Final Map"), or (2) that Developer enter into an <br />agreement with City providing for the future construction of such public improvements. <br />D . Developer has submitted the Final Map and applied to .City for Final Map approval <br />without having completed the required public improvements and, therefore, will enter into an agreement <br />with City providing for the future construction and installation of such public improvements, as required <br />by Government Code section 66462(x)(1). <br />E. Developer has submitted to City plans, specifications and drawings entitled The Towns at <br />Avondale Improvement Plans, prepared by BKF Engineers and dated, 201( (the <br />"Improvement Plans"), which, in addition to other improvements, provide for cert n on-site and off-site <br />public improvements consisting of street improvements, street Iights and joint trench systems, storm drain <br />systems, domestic water systems and sanitary sewer systems for the Project (collectively, <br />"Improvements"). <br />F.
