6.F. - Page 20 of 31 <br />WHEREAS, the City has an important governmental interest in maintaining a <br />thriving business community and protecting the health, safety, and economic welfare <br />of its residents and businesses; and <br />WHEREAS, in order to protect the health and safety of the City, while <br />fostering economic well-being of the City's citizens and businesses, the City wishes <br />to assist businesses in remaining open, or re -opening when lawfully permitted to do <br />so; and <br />WHEREAS, Appendix C-1 of County Order No. c19-11 allows "outdoor <br />dining", subject to certain restrictions and provides that outdoor dining provides <br />access to freshly prepared meals at a relatively low risk of transmission; because <br />food service will be limited to outdoor areas, the overall volume of increased activity <br />will be modest; interactions and activities that occur outdoors carry a lower risk of <br />transmission than most indoor interactions and activities; and risks associated with <br />these operations can be substantially mitigated with conditions to ensure adequate <br />social distancing and limit intermixing between households; and <br />WHEREAS, it is up to local jurisdictions such as the City to facilitate outdoor <br />dining in accordance with the County Health Requirements, which impose a variety <br />of space intensive requirements on restaurants and other food facilities seeking to <br />provide outdoor dining services; and <br />WHEREAS, on June 15, 2020, the City Manager acting as the Director of <br />Emergency Services issued a proclamation allowing for outdoor dining on public and <br />private property, as specified therein; and <br />WHEREAS, on June 22, 2020, the City Council ratified the June 15, 2020 <br />proclamation allowing the closure of certain Downtown Streets to allow for Outdoor <br />Dining from June 22, 2020 to September 30, 2020; and <br />WHEREAS, tables and chairs are intended to be located in the public right of <br />way, and the temporary closure of certain streets, as more particularly shown in <br />Exhibit A, attached hereto and incorporated by reference, is clearly necessary <br />for the safety and protection of persons using said streets; and <br />WHEREAS, to date, forty restaurants have participated in the Temporary <br />Outdoor Dining Program, thirty-eight of which are located in the Downtown; and <br />WHEREAS, a recent survey of program participants showed that Downtown <br />restaurants felt the temporary outdoor program was very helpful and they would like <br />to see the program extended through the end of the calendar year; and <br />ATTY/RESO.0087/CC RESO AUTHORIZING EXTENSION OF TEMPORARY STREET CLOSURE <br />REV: 09-09-20 PR <br />Page 2 of 3 <br />271 <br />
