6.G. - Page 3 of 12 Historic Resources Advisory Committee Included in the above-mentioned ordinance (Attachment B) is an amendment to section 40.4.1 of the Municipal Code to allow members to serve in their term until their successor is appointed and qualified. This ordinance amendment also changes the HRAC members' term expiration date from July 31 to May 31. Through research, staff has not been able to identify how the current term expiration date was assigned and has concluded that it was likely administratively assigned. Through this action, staff proposes to codify the alignment of this date with the majority of other BCC term expiration dates, May 31. Further, the proposed ordinance removes existing Municipal Code language that is in conflict with the City's new BCC Attendance policy. If adopted at this City Council meeting, these changes would take effect thirty days later, resulting in the shortening of two current HRAC member terms by two months. The affected members were notified of their term adjustment. Despite this change, current members whose terms would expire would still be allowed to serve until their successors are appointed and qualified. FISCAL IMPACT The recommended action increases staff efficiency in administration of BCCs and modestly reduces advertising costs for BCC recruitments. ENVIRONMENTAL REVIEW This activity is not a project under California Environmental Quality Act (CEQA) as defined in CEQA Guidelines, section 15378, because it has no potential for resulting in either a direct or reasonably foreseeable indirect physical change in the environment. PUBLIC NOTICE Public notification was achieved by posting the agenda, with the agenda items being listed, at least 72 hours prior to the meeting. ALTERNATIVES The City Council may choose not to adopt the ordinance and direct staff to make additional changes.
