09/14/2020 <br />RESOLUTION NO. 15882 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD <br />CITY SUMMARILY VACATING A PUBLIC UTILITY EASEMENT <br />LOCATED ON THE PROPERTY AT 112 VERA AVENUE <br />WHEREAS, pursuant to the provisions of Chapter 4, Part 3 (commencing at <br />Section 8330) of Division 9 of the California Streets and Highways Code, the City <br />Council ("City Council") of the City of Redwood City ("City") may summarily vacate <br />public service easements, if such easements are determined to be excess by the <br />easement holder, and there are no other public facilities located within the easement; <br />and <br />WHEREAS, the City Council intends to summarily vacate the public utility <br />easement located at 112 Vera Avenue as described in Book 1290 of Official Records, at <br />Page 92 in the office of the Recorder for the County of San Mateo, and as described <br />and depicted in Exhibit "A" and Exhibit "B", attached hereto and incorporated by <br />reference ("Vacation Area"); and <br />WHEREAS, the property owner (Robert J Galet) proposes to take over the <br />maintenance responsibility of the existing potable water services and sanitary sewer <br />laterals located in the Vacation Area; and <br />WHEREAS, upon the City's acceptance and recordation of this resolution, the <br />Vacation Area will be determined to be excess pursuant to Streets and Highways Code <br />Section 8333. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF REDWOOD CITY AS FOLLOWS: <br />1. The recitals set forth above are true and correct, and are hereby incorporated <br />herein by this reference as if fully set forth in their entirety. <br />2. The easement located in the Vacation Area described and depicted in Exhibit <br />"A" and Exhibit "B" has been determined to be excess by the easement holder. <br />3. There are no other public service facilities located within the Vacation Area. <br />4.
