09/14/2020
WHEREAS, a recent survey of program participants showed that Downtown
restaurants felt the temporary outdoor program was very helpful and they would like
to see the program extended through the end of the calendar year; and
WHEREAS, the City Council desires to extend street closures and make
public rights of way and City -owned property available for outdoor dining services
through January 31, 2021.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDWOOD
CITY HEREBY RESOLVES AS FOLLOWS:
SECTION 1. The above recitals are accurate, constitute findings in this
matter, and are hereby incorporated into this reference.
SECTION 2. CEQA. This activity is not a project under California
Environmental Quality Act (CEQA) as defined in CEQA Guidelines Section 15378,
because it has no potential for resulting in either a direct or reasonably foreseeable
indirect physical change in the environment. Similarly, the proposed activity falls
within the scope of CEQA Guidelines Section 15061(b)(3), in that it can be seen with
certainty that there is no possibility that the activity in question, namely outdoor
dining on public and private property, will have a significant effect on the
environment. Separately and independently, even if the activity constituted a project
under CEQA, it would be exempt as set forth in CEQA Guidelines Section 15304,
because the use of existing streets, sidewalks and private property for outdoor dining
constitutes a minor temporary use of land having negligible or no permanent effects
on the environment.
SECTION 3. The City Manager is hereby authorized to temporarily close the
City streets identified in the outdoor dining map attached as Exhibit "A", for seven
(7) days a week, or for shorter periods of time as determined by the City Manager,
until January 31, 2021. The City Manager is further authorized to reopen the streets
identified in Exhibit A at an earlier date.
SECTION 4. The City Manager is further authorized to make adjustments in
the temporary closure of City streets identified in Exhibit "A" and the reopening of
said streets, and take other implementing actions, in order to comply with the County
Health Requirements, as amended from time to time.
SECTION 5. This resolution shall expire when repealed or upon a declared
termination of the state of emergency regarding COVID-19 by the City Council.
SECTION 6. This resolution shall be effective upon the date of its adoption.
ATTY/RESO.0087/CC RESO AUTHORIZING EXTENSION OF TEMPORARY STREET CLOSURE RESO.
