09/14/2020 <br />WHEREAS, a recent survey of program participants showed that Downtown <br />restaurants felt the temporary outdoor program was very helpful and they would like <br />to see the program extended through the end of the calendar year; and <br />WHEREAS, the City Council desires to extend street closures and make <br />public rights of way and City -owned property available for outdoor dining services <br />through January 31, 2021. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDWOOD <br />CITY HEREBY RESOLVES AS FOLLOWS: <br />SECTION 1. The above recitals are accurate, constitute findings in this <br />matter, and are hereby incorporated into this reference. <br />SECTION 2. CEQA. This activity is not a project under California <br />Environmental Quality Act (CEQA) as defined in CEQA Guidelines Section 15378, <br />because it has no potential for resulting in either a direct or reasonably foreseeable <br />indirect physical change in the environment. Similarly, the proposed activity falls <br />within the scope of CEQA Guidelines Section 15061(b)(3), in that it can be seen with <br />certainty that there is no possibility that the activity in question, namely outdoor <br />dining on public and private property, will have a significant effect on the <br />environment. Separately and independently, even if the activity constituted a project <br />under CEQA, it would be exempt as set forth in CEQA Guidelines Section 15304, <br />because the use of existing streets, sidewalks and private property for outdoor dining <br />constitutes a minor temporary use of land having negligible or no permanent effects <br />on the environment. <br />SECTION 3. The City Manager is hereby authorized to temporarily close the <br />City streets identified in the outdoor dining map attached as Exhibit "A", for seven <br />(7) days a week, or for shorter periods of time as determined by the City Manager, <br />until January 31, 2021. The City Manager is further authorized to reopen the streets <br />identified in Exhibit A at an earlier date. <br />SECTION 4. The City Manager is further authorized to make adjustments in <br />the temporary closure of City streets identified in Exhibit "A" and the reopening of <br />said streets, and take other implementing actions, in order to comply with the County <br />Health Requirements, as amended from time to time. <br />SECTION 5. This resolution shall expire when repealed or upon a declared <br />termination of the state of emergency regarding COVID-19 by the City Council. <br />SECTION 6.
