09/14/2020 <br />WHEREAS, the City does not currently have an ordinance specifically addressing <br />large non-commercial vehicles, such as recreational vehicles like motor homes and boat <br />trailers; and <br />WHEREAS, the City desires to enact an ordinance enabling the regulation of <br />parking of large non-commercial vehicles on City streets to improve public safety and <br />ease parking congestion; and <br />WHEREAS, Chapter 20, Article VII, Division 13 of the Redwood City Municipal <br />Code regulates sleeping in vehicles; and <br />WHEREAS, the City has determined that Chapter 20, Article VII, Division 13 of the <br />Redwood City Municipal Code is likely unconstitutional and thus has stopped enforcing <br />the Sections contained therein; and <br />WHEREAS, the City desires to repeal Chapter 20, Article VII, Division 13 of the <br />Redwood City Municipal Code accordingly. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDWOOD CITY <br />DOES ORDAIN AS FOLLOWS: <br />Section 1. The recitals set forth above are true and correct, and are hereby <br />incorporated herein by this reference as if fully set forth in their entirety. <br />Section 2. The City Council of the City of Redwood City adopts the amendments <br />to Chapter 20, Article VII, by adding the text shown in underline (example) and deleting <br />the text shown in strikeout (example), as shown below. Wording in brackets ([example]) is <br />informational only and is not to be included in the published ordinance. <br />Section 3. Section 20.101(A) of Chapter 20, Article VI I, Division 1 of the Redwood <br />City Municipal Code is hereby amended to read as follows: <br />A. For purposes of this Section, the term "commercial vehicle" shall have the <br />meaning ascribed to it by Vehicle Code Section 260, and the term "oversized" <br />shall mean a commercial vehicle that has any one of the following <br />characteristics: exceeds twenty-four and one-half (24.5) feet in overall length <br />(including any load or accessory thereon); or that has a manufacturer's gross <br />vehicle weight rating of more than eight thousand (8,000) pounds: has a height <br />greater than seven and one-half 17.2 feet-, or has a width greater than seven <br />and one-half (7.5) feet. <br />[All other subsections of 21.101 remain unchanged.] <br />Section 4.
