have a current Best's Key Rating of not less than "A:VII." <br />17.1 Coverages and Limits. Performers, at their sole expense, will <br />maintain the types of coverages and minimum limits indicated below, unless the <br />Risk Manager or City Manager, in consultation with the City Attorney, approves <br />a lower amount. These minimum amounts of coverage will not constitute any <br />limitations or cap on Performers' indemnification obligations under this <br />Agreement. City, its officers, agents, volunteers and employees make no <br />representation that the limits of the insurance specified to be carried by <br />Performers pursuant to this Agreement are adequate to protect Performers. If <br />Performers believe that any required insurance coverage is inadequate, <br />Performers will obtain such additional insurance coverage, as Performers deem <br />adequate, at Performers' sole expense. <br />17.1.1 Commercial General Liability Insurance. $2,000,000 combined <br />single- limit per occurrence for bodily injury, personal injury and property <br />damage. If the submitted policies contain aggregate limits, general <br />aggregate limits will apply separately to the work under this Agreement <br />or the general aggregate will be twice the required per occurrence limit. <br />17.1.2 Automobile Liability. $1,000,000 combined single -limit per <br />accident for bodily injury and property damage. <br />17.1.3 Workers' Compensation and Employer's Liability. Workers' <br />Compensation limits as required by the California Labor Code and <br />Employer's Liability limits of $1,000,000 per accident for bodily injury. <br />Workers' Compensation and Employer's Liability insurance will not be <br />required if Performers have no employees and provides, to City's <br />satisfaction, a declaration stating this. Performers will provide a waiver <br />of subrogation in favor of the City from their Worker's Compensation and <br />Employer's Liability carrier. <br />17.2. Additional Provisions. Performers will ensure that the policies of <br />insurance required under this Agreement contain, or are endorsed to contain, <br />the following provisions: <br />REV: 09-03-2020 RL <br />17.2.1 For Commercial General Liability Insurance and Automobile <br />Liability Insurance: City, its officers, agents, volunteers and employees <br />will be named as additional insureds. <br />17.2.2 Performers will obtain occurrence coverage. <br />17.2.3 This insurance will be in force during the life of the Agreement <br />and any extensions of it and will not be canceled without thirty (30) days <br />prior written notice to City sent pursuant to the Notice provisions of this <br />Agreement. <br />17.2.4.
