7.A. - Page 8 of 176 <br />RESOLUTION NO. <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD <br />CITY APPROVING AMENDED AND RESTATED STATEMENT OF <br />LOCAL GOALS AND POLICIES FOR COMMUNITY FACILITIES <br />DISTRICTS <br />WHEREAS, the City of Redwood City (the "City") has authority to establish <br />community facilities districts under (i) the Mello -Roos Community Facilities Act of 1982, <br />as amended (the "Mello -Roos Act") and (ii) the City's Special Tax Financing Law (the <br />"Special Tax Financing Law"), which was adopted by the City Council pursuant to <br />Ordinance No. 2480, State Constitution Article XI, Section 5 and Section 3 of the Charter <br />of the City (the "Charter"), and which incorporates the Mello -Roos Act where not <br />inconsistent with the Special Tax Financing Law; and <br />WHEREAS, under Section 53312.7 of the Mello -Roos Act, the City is obligated to <br />adopt local goals and policies concerning the use of the Mello -Roos Act prior to the <br />institution of any proceedings to establish a community facilities district; and <br />WHEREAS, this Council previously approved a "Statement of Local Goals and <br />Policies Concerning the Use of Mello -Roos Community Facilities Act" by Resolution No. <br />15494, adopted on May 23, 2016 (the "Existing Goals and Policies"); and <br />WHEREAS, this Council wishes to amend and restate the Existing Goals and <br />Policies for the purpose of complying with requirements of the Mello -Roos Act and to <br />further update the Existing Goals and Policies; <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />REDWOOD CITY AS FOLLOWS: <br />Section 1. Approval. The "Amended and Restated Statement of Local Goals <br />and Policies for Community Facilities Districts" (the "Amended Goals and Policies") <br />attached hereto as Exhibit A are hereby found to meet the requirements of the Mello - <br />Roos Act and are hereby adopted by this Council for this City for purposes of compliance <br />with the Mello -Roos Act, subject to further amendment by this Council as may be required <br />from time to time. <br />Section 2. Effective Date.
