7.A. - Page 19 of 176 <br />RESOLUTION NO. <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD <br />CITY DECLARING ITS INTENTION TO ESTABLISH CITY OF REDWOOD <br />CITY COMMUNITY FACILITIES DISTRICT NO. 2020-1 (SEAPORT <br />CENTRE/SEAPORT PLAZA), AND APPROVING RELATED <br />DOCUMENTS AND ACTIONS <br />WHEREAS, under City of Redwood City's (the "City") Special Tax Financing Law <br />(Chapter 32, Article XIII of the Redwood City Municipal Code) (the "CFD Law") which <br />incorporates the Mello -Roos Community Facilities Act of 1982, as amended (the "Act"), <br />this City Council (the "Council") is authorized to establish a community facilities district <br />and to act as the legislative body for a community facilities district; and <br />WHEREAS, this Council has received a petition from the owners of more than ten <br />percent of the area of land proposed to be included in the proposed community facilities <br />district described herein that would be subject to the special tax, and wishes to proceed <br />with the establishment of a community facilities district in order to finance costs of (i) <br />acquisition, construction, improvement and replacement of certain levee and flood control <br />improvements within the proposed community facilities district and (ii) operation and <br />maintenance of all of the public improvements and appurtenant facilities described in <br />Exhibit A hereto, including such levee and flood control improvements; and <br />WHEREAS, three parcels of land proposed to be included in the proposed <br />community facilities district (the "City Parcels") are owned by the City and initially would <br />be exempt from the special tax, but it is proposed that the City Parcels be subject to the <br />special tax if (a) they are transferred by conveyance of the fee interest to private <br />ownership or (b) leased to a nonexempt person or entity, and the City wishes to provide <br />for certain matters related to such City Parcels. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />REDWOOD CITY AS FOLLOWS: <br />Section 1. Authority. This Council proposes to conduct proceedings to <br />establish a community facilities district pursuant to the CFD Law. <br />Section 2. Name of CFD. The name proposed for the community facilities <br />district is "City of Redwood City Community Facilities District No. 2020-1 (Seaport <br />Centre/Seaport Plaza)" (the "CFD"). <br />Section 3. Boundaries Described.
