7.A. - Page 23 of 176 <br />Section 11. Acceptance of Reserve Funds. The City previously formed the <br />Seaport Centre Maintenance District pursuant to Ordinance No. 1895 (codified in Article <br />XIII of Chapter 18 of the Redwood City Code), Chapter 26 of the Improvement Act of <br />1911, Resolution No. 9815 adopted by the City Council on March 4, 1985 and Resolution <br />No. 9859 adopted by the City Council on April 22, 1985. The Seaport Centre Maintenance <br />District currently funds certain of the Services related to Seaport Centre and has funded <br />certain maintenance reserves (the "Maintenance District Reserves") held by the City. <br />Consistent with the request of the owners of the parcels constituting Seaport <br />Centre, the City Council intends to provide for termination of the Seaport Centre <br />Maintenance District in connection with formation of the CFD and, after dissolution of the <br />Seaport Centre Maintenance District, to deposit the remaining funds in the Maintenance <br />District Reserves into one or more maintenance reserve funds to be established and held <br />by the City as a result of forming the CFD. <br />Section 12. Public Hearing. Section 32.987 of the CFD Law authorizes any <br />procedure not expressly set forth in the CFD Law but deemed necessary or convenient <br />by the City Council to carry out any of the purposes of the CFD Law. The property owners <br />in the CFD have petitioned the City Council to hold the public hearing required by the <br />CFD Law as soon as possible after the adoption of this Resolution. The City Council <br />hereby determines that it is necessary and convenient for Monday, November 23, 2020, <br />at 7:00 p.m. or as soon as possible thereafter, to be appointed and fixed as the time and <br />place when this Council, as legislative body for the CFD, will conduct a public hearing on <br />the establishment of the CFD and consider and finally determine whether the public <br />interest, convenience and necessity require the formation of the CFD and the levy of the <br />Special Tax. In accordance with Governor Newsom's Executive Order No. N-29-20, the <br />City Clerk is hereby directed to notify interested parties that they may participate in the <br />public hearing by teleconference. <br />Section 13. Notice of Hearing. The Clerk is hereby directed to cause notice of <br />the public hearing to be given by publication one time in a newspaper published in the <br />area of the CFD. The publication shall be completed at least seven days before the date <br />of the public hearing specified above. The notice shall be substantially in the form <br />specified in Section 53322 of the Act, with the form summarizing the provisions hereof <br />hereby specifically approved. <br />Section 14. California Environmental Quality Act. The City Council hereby <br />adopts and incorporates by reference as though fully set forth herein its findings related <br />to the Facilities in Resolution No. —adopted on October 26, 2020, for purposes of <br />complying with the California Environmental Quality Act (California Public Resources <br />Code, Section 21000 et seq.). <br />Section 15. No Obligation. This Resolution shall in no way obligate the City <br />Council to form the CFD.
