The City is willing <br />to grant Permittee a non-exclusive encroachment permit to encroach upon and use the Property upon the <br />terms set forth in this Permit, <br />Unless otherwise specified in the Permit, Perwittee shall begin work or use authorized by the Permit within <br />one hundred eighty (180) days from date of issuance. If the work or use is not so begun, then the Permit <br />shall become void. Where an encroachment involves a permanent installation or obstruction, conditions so <br />specified in the Permit, license or other agreement with the City shall remain in effect until the construction or <br />obstruction is removed. Permits may be renewed or extended at the City's discretion and upon such terms <br />as are consistent with the provisions of Chapter 29 of the Municipal Code. <br />Any encroachment, including but not limited to pipes, conduit, wire, cable, appurtenances or other structures <br />orfacilities, installed or maintained in, on, under or over the surface of any right-of-way or City property, shall <br />be relocated at the sole expense of Permittee, as may be necessary for public necessity or convenience. <br />OAK #4819-4834-1908 v19 Exhibit D <br />315 <br />
