Permittee shall use the Property solely for the purpose of <br />and for no other purpose whatsoever (the "Permitted Activity"). Permittee shall not use the Property to <br />transport or store materials, including, without limitation, any Hazardous Substances, as defined in <br />Special Provision 16, below. <br />2. Permittee shall not use or permit the use of the Property in any manner that would tend to create waste <br />ora nuisance or in a way that compromises the public health, safety, or welfare, or the public's use ofthe <br />right-of-way. <br />3. All of Permittee's Activities shall be performed at Permittee's sole cost, risk and expense. Except as <br />expressly provided herein, this Permit does not entitle Permittee to install any improvements on the <br />Property. <br />4. Permittee expressly acknowledges and agrees that City has no obligation to maintain or repair the <br />Property, or the improvements located thereon, and Permittee accepts use of the Property in its AS -IS <br />condition. Permittee acknowledges that it has inspected the Property and Permittee warrants and agrees <br />that it is thoroughly familiar with the Property and all aspects thereof, including, without limitation, the <br />physical condition of the Property, the zoning of the Property, and all other restrictions and limitations <br />applicable to the Property (whether or not of public record). Permittee acknowledges and agrees that the <br />Property is satisfactory to Permittee in all respects. Permittee agrees that neither City nor anyone acting <br />on City's behalf has made any representation or warranty of any kind or nature whatsoever respecting <br />the condition of the Property, its suitability for Permittee's intended use, or any other matter relating to <br />the Property (including, but not limited to, the environmental condition of the Property) or this Permit, and <br />Permittee agrees that it is taking the Property under this Permit in its "AS -IS CONDITION AND WITH <br />ALL FAULTS". <br />5. This Permit is not intended to nor shall it be interpreted to create or vest in Permittee any franchise, <br />leasehold, or any other property rights or interests in the Property, or the improvements located thereon, <br />or any part thereof.
