10/26/2020 <br />RESOLUTION NO. 15901 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD <br />CITY DECLARING ITS INTENTION TO ESTABLISH CITY OF REDWOOD <br />CITY COMMUNITY FACILITIES DISTRICT NO. 2020-1 (SEAPORT <br />CENTRE/SEAPORT PLAZA), AND APPROVING RELATED <br />DOCUMENTS AND ACTIONS <br />WHEREAS, under City of Redwood City's (the "City") Special Tax Financing Law (Chapter <br />32, Article XIII of the Redwood City Municipal Code) (the "CFD Law") which incorporates the <br />Mello -Roos Community Facilities Act of 1982, as amended (the "Act"), this City Council (the <br />"Council") is authorized to establish a community facilities district and to act as the legislative body <br />for a community facilities district; and <br />WHEREAS, this Council has received a petition from the owners of more than ten percent <br />of the area of land proposed to be included in the proposed community facilities district described <br />herein that would be subject to the special tax, and wishes to proceed with the establishment of <br />a community facilities district in order to finance costs of (i) acquisition, construction, improvement <br />and replacement of certain levee and flood control improvements within the proposed community <br />facilities district and (ii) operation and maintenance of all of the public improvements and <br />appurtenant facilities described in Exhibit A hereto, including such levee and flood control <br />improvements. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />REDWOOD CITY AS FOLLOWS: <br />Section 1. Authority. This Council proposes to conduct proceedings to establish a <br />community facilities district pursuant to the CFD Law. <br />Section 2. Name of CFD. The name proposed for the community facilities district is <br />"City of Redwood City Community Facilities District No. 2020-1 (Seaport Centre/Seaport Plaza)" <br />(the "CFD"). <br />Section 3. Boundaries Described. The proposed boundaries of the CFD are as <br />shown on the map on file with the City Clerk (the "Clerk"), which boundaries are hereby <br />preliminarily approved and to which map reference is hereby made for further particulars. The <br />Clerk is hereby directed to record, or cause to be recorded, the map of the boundaries of the CFD <br />in the office of the San Mateo County Recorder within 15 days of the date of adoption of this <br />Resolution, but in any event at least 15 days prior to the public hearing specified below. <br />Section 4. Facilities and Services. The type of public facilities proposed to be <br />financed by the CFD and pursuant to the CFD Law shall consist of those listed as facilities on <br />Exhibit A hereto and hereby incorporated herein (the "Facilities'). This Council hereby determines <br />that the Facilities are necessary to meet the requirements imposed by the Federal Emergency <br />Management Agency ("FEMA") in its current flood insurance rate maps for the area within the <br />CFD, and increased demands placed upon the City as the result of anticipated future development <br />or redevelopment within the CFD. The Facilities will benefit the properties in the CFD.
