Identify the cost of providing capital facilities to accommodate students on a <br />per -student basis, by the District. <br />23. Identify the expected shortfall or excess between the estimated development <br />fees to be generated by the Project and the cost for provision of capital <br />facilities. <br />24. Assess the District's present and projected capital facility, operations, <br />maintenance, and personnel costs. <br />25. Assess financing and funding sources available to the District, including but <br />not limited to those mitigation measures set forth in Section 65996 of the <br />Government Code. <br />26. Identify any expected fiscal impacts on the District, including an assessment <br />of projected cost of land acquisition, school construction, and other facilities <br />needs. <br />27. Assess cumulative impacts on schools resulting from additional development <br />already approved or pending. <br />As discussed above, the Project will have numerous impacts on the District's ability to provide <br />its educational program. Furthermore, the City's reliance upon SB 50 as the sole mitigation <br />measure to any impacts caused by the Project is both legally and practically improper, as <br />developer fees are legally and practically inadequate to mitigate all impacts caused by the <br />Project. Accordingly, the District submits that each of the above scoping requests must be <br />directly discussed in the EIR. <br />Conclusion <br />The District does not oppose development within District boundaries, and recognizes the <br />importance of housing on the health and welfare of the community. However, the District <br />maintains that the community can only thrive if the District's educational program and its <br />facilities are viable and sufficient, and District staff, families, and students are safe. <br />Accordingly, the needs of the District must be appropriately considered in the environmental <br />review process for all proposed new development that will impact the District, such as the very <br />large Project under consideration. <br />The District is hopeful that its continued collaboration with Developer and the City will yield <br />solutions that alleviate the impacts caused by the Project, and is prepared to provide any <br />information necessary to assist the City in preparation of the EIR and in addressing each of the <br />comment and scope/content issues set forth above. <br />We request that all notices and copies of documentation with regard to this Project be mailed <br />both to the District directly, and also to our legal counsel's attention as follows: <br />
