11/09/2020 <br />nurseries in the Commercial Office (CO) Zoning Districts upon approval of a Conditional <br />Use Permit and with a 600 ft. buffer from protected uses; and <br />WHEREAS, on August 24, 2020, the City Council of Redwood City held a duly - <br />noticed study session on retail cannabis and on said date the study session was held, <br />public comment was opened and closed, and all interested members of the public were <br />afforded an opportunity to be heard; and <br />WHEREAS, on September 15, 2020, the Planning Commission held a duly - <br />noticed public hearing on the proposed zoning ordinance amendments and on said date <br />the public hearing was opened, held, and closed and all interested members of the public <br />were afforded an opportunity to be heard; and <br />WHEREAS, the proposed amendments to Article 59 of the Zoning Ordinance would <br />permit retail cannabis uses in the Downtown Precise Plan, the Mixed -Use Corridor, Mixed - <br />Use Neighborhood, Mixed -Used Transitional, Mixed -Use Waterfront, General Commercial, <br />Neighborhood Commercial, Light Industrial Incubator, Industrial Park, and Industrial <br />Restricted Zoning Districts with a 600 ft. buffer from protected uses (the "Zoning Ordinance <br />Amendment"); and <br />WHEREAS, at the public hearing the Planning Commission considered the staff <br />reports, oral and written, and testimony and materials presented by all those wishing to <br />be heard on the Zoning Ordinance Amendment and recommended approval of the Zoning <br />Ordinance Amendment; and <br />WHEREAS, on October 2, 2020, a public hearing notice was published in the San <br />Mateo Daily Journal; and <br />WHEREAS, on October 12, 2020, a public hearing was held and the City Council <br />considered the whole of the record and public comments received. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDWOOD CITY <br />DOES ORDAIN AS FOLLOWS: <br />Section 1. The recitals set forth above are true and correct, and are hereby <br />incorporated herein by this reference as if fully set forth in their entirety. <br />Section 2. The City Council hereby finds that the proposed Zoning Ordinance <br />Amendments are in the public interest and consistent with the Redwood City General Plan. <br />Section 3. The proposed Zoning Ordinance Amendments have been reviewed <br />with respect to applicability of the California Environmental Quality Act ("CEQA") and the <br />State CEQA Guidelines (California Code of Regulations, Title 14, Sections 15000 et seq.). <br />As explained in the CEQA memo, two exemptions apply. For the proposed retail <br />businesses allowed by right, the Zoning Ordinance Amendment is exempt from CEQA as <br />it can be seen with certainty that there is no possibility for causing a significant effect on <br />ATTY/ORD.524/CC ORD AMENDING ARTICLE 59 OF ZO TO ALLOW STOREFRONT RETAIL ORDINANCE NO. 1130-382 <br />REV: 10-07-2020 MI MUFF NO. 602 <br />Page 2 of 8 <br />
