11/09/2020 <br />h. Conviction for unauthorized, unpermitted, or unlawful cannabis activities in <br />any city, county or city and county in the five (5) years immediately preceding <br />the issuance of a cannabis business permit or cannabis business permit <br />renewal. <br />4. The applicant and each owner have not been convicted, cited, fined, or penalized <br />by the State or any city, county, or city and county, or enjoined by any court of <br />law, in the five (5) years immediately preceding the application for a cannabis <br />business permit or cannabis business permit renewal, for any unauthorized, <br />unpermitted, or unlawful cannabis activities. <br />5. The applicant and each owner have not been convicted, cited, fined, or penalized <br />by the State or any city, county, or city and county, or enjoined by any court of <br />law, in the five (5) years immediately preceding the application for a cannabis <br />business permit or cannabis business permit renewal, for cultivation or <br />production of a controlled substance on public or private lands. <br />6. Security Plan. The applicant has provided a Security Plan that meets the <br />minimum standards set forth in these regulations and any applicable City <br />Manager regulations. <br />C. Storefront retail. The City Manager or his or her designee shall approve up to six <br />6 cannabis business permits for storefront retail in accordance with the process <br />below. <br />1. The City Manager shall promulgate the procedures to govern the application <br />process and the manner in which the decision will ultimately be made regarding <br />the issuance of any cannabis business permit for storefront retail which shall <br />require the City Manager to provide detailed review criteria to be evaluated on a <br />point system or equivalent guantitative evaluation scale tied to each set of <br />review criteria. <br />2. The City Manager shall establish review criteria to rank applications which shall <br />include but not be limited to the following: <br />a. Previous experience operating a commercial cannabis business that <br />operated in cam liance with all local and state laws and regulations, or <br />experience in a similarly state -re ulated activity e.g., alcohol sales that <br />was operated in com liance with all local and state laws and rectulations. <br />b. Employee training and standard ogerating procedures. <br />c. Security program. <br />e. Additional information that demonstrates the ability to operate in a safe <br />and responsible manner in„the City. <br />3. The City Manager or his or her desi nee s shall conduct an initial review, <br />scorin.q, and ranking of complete applications using one or more of the review <br />criteria.
