construction of the affordable units on Parcels A and D, the applicant shall not receive a certificate <br />of occupancy (including temporary certificate of occupancy) for any market rate unit on Parcels A <br />or D. <br />Prior to issuance of a certificate of occupancy (including a temporary certificate of occupancy) of <br />the first commercial building, the applicant shall have completed the podium level on at least one <br />of the residential buildings, or provide a deposit with the City for the pro -rata share of the affordable <br />housing impact fee for the commercial building receiving occupancy. <br />Prior to issuance of a certificate of occupancy (including a temporary certificate of occupancy) of <br />the second commercial building, the applicant shall have completed construction (obtained a <br />temporary certificate of occupancy) on at least one of the residential buildings, or provide a deposit <br />with the City for the pro -rata share of the affordable housing impact fee for the commercial building <br />receiving occupancy. <br />Prior to issuance of a certificate of occupancy (including a temporary certificate of occupancy) of <br />the final commercial building, the applicant shall have completed construction (obtained a <br />temporary certificate of occupancy) on all of the 147 affordable housing units, or provide a deposit <br />with the City for the pro -rata share of the remaining balance of the affordable housing impact fee <br />for the commercial development. <br />The affordable housing impact fee for the commercial development shall be $20 per sq. ft. based <br />on the net new square footage of office created by the Project (503,746 sq. ft.), for an amount of <br />$10,074,920. The Project does not result in net new square footage of retail or hotel space, <br />therefore an affordable housing impact fee is not charged for those use types. <br />The City shall hold the deposit(s) in a separate, interest bearing account and return the deposit(s) <br />at the issuance of the final certificate of occupancy for the affordable housing units within each <br />building. Should the applicant fail to complete the construction of the 147 affordable housing units <br />within five years of the first building permit for the project, the City shall retain the pro -rata share <br />of the deposit(s) based on the number of affordable units not completed. Alternatively, at the <br />Developer's election, and subject to City Council approval, the unfinished affordable housing units <br />required by a particular office building may be provided within a completed residential <br />building(s). (For example, if a deposit is paid for Building B and the designated affordable units <br />anticipated within one residential building (e.g. Building A) are not complete after 5 years of the first <br />building permit issuance, but Building D has been completed, the Building B affordable units may be <br />provided within Building D.) A one-year extension may be granted if requested prior to the <br />expiration date. [COA][PLANNING] <br />5.
