11/16/2020 <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />REDWOOD CITY AS FOLLOWS: <br />Section 1. Evidentiary Basis: The City Council, having independently heard, <br />considered, and weighed all the evidence in the record, finds that the above recitals are accurate <br />and constitute findings in this matter and, together with the staff report, the Purchase and Sale <br />Agreement, and Relocation Plan have served as an adequate and appropriate evidentiary basis <br />for the findings and actions set forth in this resolution. <br />Section 2. Surplus Lands: Pursuant to Article V of Chapter 2 of the Redwood City Code, <br />the City has determined that the interests to be conveyed in the Property to the Developer are not <br />necessary for City use and further are not "surplus land" as defined therein. This determination is <br />based on the following facts: <br />A. Under Section 2.42(C)(2)(a) of the City Code, the disposition of the City <br />Property will secure certain community benefits, including construction of 23 replacement <br />housing units, 22 of which will be affordable to very low and extremely low income <br />households, seven of which will be affordable to extremely low-income households, which <br />exceeds the required affordability level, construction of an additional 125 affordable <br />housing units; construction and operation of a childcare facility on the Project site, and <br />construction of 40,000 sq. ft. of publicly -accessible open space on the Project Site. <br />B. Under Section 2.42(C)(2)(c) of the City Code, the disposition and <br />development of the Property serves a common benefit by allowing better and more <br />compatible uses, including affordable housing, childcare facilities, and publicly -accessible <br />open space, than its present use and will further the purposes of the General Plan, through <br />the provision of transit -oriented housing, removing ongoing maintenance obligations <br />associated with the Property, and community benefits, also thereby implementing General <br />Plan goals and policies. <br />Section 3. Purchase and Sale Agreement: The City Council hereby authorizes and <br />directs the City Manager to execute the Purchase and Sale Agreement, subject to any minor, <br />clarifying and conforming changes approved by the City Attorney. The City Council further <br />authorizes the City Manager to take all actions necessary to carry out the Purchase and Sale <br />Agreement for the development of the Project. <br />Section 4. Relocation Plan: The City Council hereby approves the Relocation Plan. <br />Section 5.
