11/23/2020 RESOLUTION NO. 15915 A RESOLUTION OF THE CITY COUNCIL OF THE CITY REDWOOD CITY FORMING CITY OF REDWOOD CITY COMMUNITY FACILITIES DISTRICT NO. 2020-1 (SEAPORT CENTRE/SEAPORT PLAZA), AND APPROVING RELATED DOCUMENTS AND ACTIONS WHEREAS, under City of Redwood City's (the "City") Special Tax Financing Law (Chapter 32, Article XIII of the Redwood City Municipal Code) (the "CFD Law") which incorporates the Mello -Roos Community Facilities Act of 1982, as amended (the "Act"), this City Council (the "City Council") is authorized to establish a community facilities district and to act as the legislative body for a community facilities district; and WHEREAS, on October 26, 2020, the City Council adopted a resolution entitled "A Resolution of the City Council of the City of Redwood City Declaring its Intention to Establish City of Redwood City Community Facilities District No. 2020-1 (Seaport Centre/Seaport Plaza), and Approving Related Documents and Actions" (the "Resolution of Intention"), stating its intention to form "City of Redwood City Community Facilities District No. 2020-1 (Seaport Centre/Seaport Plaza)" (the "CFD"), pursuant to the CFD Law; and WHEREAS, the Resolution of Intention, incorporating a map of the proposed boundaries of the CFD and stating the facilities to be provided and the cost of providing such facilities, the services to be provided and the cost of providing such services, and the rate and method of apportionment of the special taxes to be levied within the CFD to pay cost of facilities, the cost of services, and the principal and interest on bonds and other debt proposed to be issued for the CFD and incidental costs related thereto, is on file with the City Clerk and the provisions thereof are incorporated herein by this reference as if fully set forth herein; and WHEREAS, on this date, the City Council held a noticed public hearing as required by the CFD Law and the Resolution of Intention relative to the proposed formation of the CFD, the levy of special taxes therein and the types of facilities and services to be financed thereby; and WHEREAS, at the hearing all interested persons desiring to be heard on all matters pertaining to the formation of the CFD, the facilities and services to be provided in the CFD and the levy of the special taxes were heard and a full and fair hearing was held; and WHEREAS, at the hearing evidence was presented to the City Council on said matters before it, including a report caused to be prepared by the Director of Public Works of the City (the "Report") as to the facilities and services to be provided through the CFD and the costs thereof, a copy of which is on file with the City Clerk, and the City Council at the conclusion of said hearing is fully advised on the matters set forth in the Report; and WHEREAS, protests with respect to the formation of the CFD, the furnishing of specified types of facilities and services and the rate and method of apportionment of the special taxes in the CFD have not been filed with the City Clerk by the greater of fifty percent (50%) or more of the registered voters or six registered votes residing within the territory of the CFD or property owners of one-half (1/2) or more of the area of land within the CFD and not exempt from the proposed special taxes.
