11/23/2020 <br />RESOLUTION NO. 15915 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY REDWOOD <br />CITY FORMING CITY OF REDWOOD CITY COMMUNITY FACILITIES <br />DISTRICT NO. 2020-1 (SEAPORT CENTRE/SEAPORT PLAZA), AND <br />APPROVING RELATED DOCUMENTS AND ACTIONS <br />WHEREAS, under City of Redwood City's (the "City") Special Tax Financing Law <br />(Chapter 32, Article XIII of the Redwood City Municipal Code) (the "CFD Law") which <br />incorporates the Mello -Roos Community Facilities Act of 1982, as amended (the "Act"), this City <br />Council (the "City Council") is authorized to establish a community facilities district and to act as <br />the legislative body for a community facilities district; and <br />WHEREAS, on October 26, 2020, the City Council adopted a resolution entitled "A <br />Resolution of the City Council of the City of Redwood City Declaring its Intention to Establish <br />City of Redwood City Community Facilities District No. 2020-1 (Seaport Centre/Seaport Plaza), <br />and Approving Related Documents and Actions" (the "Resolution of Intention"), stating its <br />intention to form "City of Redwood City Community Facilities District No. 2020-1 (Seaport <br />Centre/Seaport Plaza)" (the "CFD"), pursuant to the CFD Law; and <br />WHEREAS, the Resolution of Intention, incorporating a map of the proposed boundaries <br />of the CFD and stating the facilities to be provided and the cost of providing such facilities, the <br />services to be provided and the cost of providing such services, and the rate and method of <br />apportionment of the special taxes to be levied within the CFD to pay cost of facilities, the cost <br />of services, and the principal and interest on bonds and other debt proposed to be issued for the <br />CFD and incidental costs related thereto, is on file with the City Clerk and the provisions thereof <br />are incorporated herein by this reference as if fully set forth herein; and <br />WHEREAS, on this date, the City Council held a noticed public hearing as required by <br />the CFD Law and the Resolution of Intention relative to the proposed formation of the CFD, the <br />levy of special taxes therein and the types of facilities and services to be financed thereby; and <br />WHEREAS, at the hearing all interested persons desiring to be heard on all matters <br />pertaining to the formation of the CFD, the facilities and services to be provided in the CFD and <br />the levy of the special taxes were heard and a full and fair hearing was held; and <br />WHEREAS, at the hearing evidence was presented to the City Council on said matters <br />before it, including a report caused to be prepared by the Director of Public Works of the City <br />(the "Report") as to the facilities and services to be provided through the CFD and the costs <br />thereof, a copy of which is on file with the City Clerk, and the City Council at the conclusion of <br />said hearing is fully advised on the matters set forth in the Report; and <br />WHEREAS, protests with respect to the formation of the CFD, the furnishing of specified <br />types of facilities and services and the rate and method of apportionment of the special taxes in <br />the CFD have not been filed with the City Clerk by the greater of fifty percent (50%) or more of <br />the registered voters or six registered votes residing within the territory of the CFD or property <br />owners of one-half (1/2) or more of the area of land within the CFD and not exempt from the <br />proposed special taxes. <br />ATTY/RESO.0131/CC RESO FORMING RWC CFD SEAPORT CENTRE/PLAZA—APPROVING RELATED DOCUMENTS RESO.
