11/23/2020 <br />"Special Tax Report" means the annual report prepared by the City Manager pursuant to <br />Section 5 hereof. <br />"Tax Collection Schedule" means the document prepared by the City Manager pursuant to <br />Section 5 hereof, and used by the Auditor in levying the Special Taxes on the County's secured <br />property tax roll and collecting the Special Taxes each Fiscal Year. <br />"Taxable Parcel" means, initially, those parcels identified with Assessor's parcel numbers in <br />Exhibit 1 hereto as taxable parcels, and subsequently, (i) any parcels into which such initial <br />Taxable Parcels may be reconfigured and/or subdivided, (ii) any Public Parcel that is leased by a <br />public agency to a private entity and subject to taxation under Section 53340.1 of the Act, and/or <br />acquired by a private entity, and (iii) any Initial Non -Taxable Parcel for which a Building Permit <br />was issued after January 1, 2020, and on or before June 1 of the Fiscal Year preceding the Fiscal <br />Year for which the Special Taxes are being levied, for either such Initial Non -Taxable Parcel or <br />an adjacent Taxable Parcel if the Initial Non -Taxable Parcel is the basis for the increase in FAR <br />for construction on the adjacent Taxable Parcel. <br />"Tax -Exempt Parcel" means any Parcel that is a Public Parcel. However, Taxable Parcels that <br />are acquired by a public entity after the CFD Formation Proceedings shall remain subject to the <br />applicable Special Tax, except as provided in Section 53317.3 of the Act. <br />"Wet Utilities" means the Storm Drain Systems Improvements, Water Facilities and Sanitary <br />Sewer Facilities, as each term is defined in the CFD Formation Proceedings, existing in and for <br />Seaport Centre. <br />SECTION 2 DETERMINATION AND CLASSIFICATION OF PARCELS SUBJECT <br />TO SPECIAL TAX <br />Special Taxes shall be levied only on Taxable Parcels. The amount of the Special Tax for each <br />Taxable Parcel shall be determined in accordance with the provisions of Section 5 hereof. Each <br />Taxable Parcel's Special Taxes for the next Fiscal Year shall be levied against such Parcel's <br />Assessor's parcel number as it was shown on the County Assessor's records of Parcels in the <br />CFD as of the prior January 1 lien date, or such other lien date established by the County <br />Assessor. <br />The City Manager shall confirm that there are no changes to the classification of the Taxable <br />Parcels as identified on Exhibit 1 hereto. Parcels shall be classified as of their status applicable <br />in the next Fiscal Year on each Classification Date. The City Manager shall use the County's <br />assessment roll, land use codes and plot map books maintained by the Assessor, in combination <br />with official records maintained by the City regarding the prepayment of the Facilities Special <br />Taxes, recorded final maps, building permits issued, and other changes in parcel status, as the <br />basis for confirming and/or reclassifying the Parcels in the CFD. <br />Facilities Special Tax: <br />-7- <br />RESO.
