for compliance with this Agreement at least one (1) time per year upon forty-eight hours (48) <br />prior notice. The Owner agrees to cooperate in such inspection. <br />ARTICLE 4 <br />OPERATION OF THE DEVELOPMENT <br />4.1 Residential Use. <br />(a) The Affordable Units shall be used only for residential purposes, and the <br />Affordable Units shall be operated and maintained as residences for the Term of this Agreement. <br />No part of the Affordable Units shall be operated as transient housing in which the term of the <br />lease or rental agreement is less than thirty (30) days. <br />4.2 Occupancy Preferences. <br />(a) All of the Affordable Units shall be available for occupancy on a <br />continuous basis to members of the general public who are income eligible. Subject to subsection <br />(b) below, owner shall not give preference to any particular class or group of persons in renting <br />the Affordable Units, except to the extent that the Affordable Units are required to be leased to <br />50% AMI Households or 80% AMI Households. <br />(b) Applicants for vacant Affordable Units shall be given preference in the following <br />order, subject to applicable fair housing laws: (1) eligible households (based on income) of <br />which at least one adult member is employed or has been offered employment by Owner on land <br />owned by Owner in Redwood City for a minimum of 30 hours per week, at or above minimum <br />wage (including, without limitation, postdoctoral research fellows); (2) eligible households <br />(based on income) of which at least one adult member is employed or has been offered <br />employment by Owner or any affiliate of Owner for a minimum of 30 hours per week, at or <br />above minimum wage (including, without limitation, postdoctoral research fellows); (3) eligible <br />households (based on income) of which at least one adult member lives, is employed, or has <br />been offered employment, within the city limits of Redwood City; and (4) all other eligible <br />households (based on income) who do not meet the criteria for priorities (1), (2), or (3) above. <br />ARTICLE 5 <br />PROPERTY MANAGEMENT AND MAINTENANCE <br />5.1 Management Responsibilities. <br />Owner is responsible for performing or causing to be performed all management <br />functions with respect to the Affordable Units, including without limitation the selection of <br />tenants, certification and recertification of household size and income, evictions, collection of <br />rents and deposits, maintenance of interior and exterior improvements including landscaping <br />(normal wear and tear excepted), routine and extraordinary repairs, replacement of capital items, <br />and security. Owner's management shall be in accordance with all applicable laws, rules, <br />ordinances, orders, and regulations of all federal, state, county, municipal, and other <br />governmental agencies and bodies having or claiming jurisdiction and all their respective <br />departments, bureaus, and officials.
