"Area Median Income" or "AMI" means the median income for San Mateo County, <br />California, adjusted for Actual Household Size, as determined by HUD pursuant to Section 8 of <br />the United States Housing Act of 1937 and as published from time to time by the State of <br />California Department of Housing and Community Development ("HCD") in Section 6932 of <br />Title 25 of the California Code of Regulations or successor provision. <br />"CDBG Program" means the Community Development Block Grant Program, <br />established and operating pursuant to Title I of the Housing and Community Development Act of <br />1974, as amended (42 U.S.C. 5301 et seq). <br />"City's Authorized Representative" means the City Manager of the City of Redwood <br />City. <br />"City Documents" means the Loan Agreement, the Declaration, the Note, the Deed of <br />Trust, and this Agreement. <br />"City Funds" is defined in Recital B. <br />"Claims" means collectively, liabilities, losses, costs, expenses (including without <br />limitation reasonable attorneys' fees and costs of litigation), claims, demands, actions, suits, <br />judicial or administrative proceedings, penalties, deficiencies, fines, orders, and damages. <br />"Declaration" is defined in Recital D. <br />"Deed of Trust" is defined in Recital B. <br />"Eligible Household" means a household for which household Gross Income upon <br />initial occupancy does not exceed the maximum income level for a dwelling unit in the Project as <br />specified in Sections 3. 1.1 and 3.1.2. <br />"General Affordability Restriction Period" means the 55 -year period commencing <br />upon June 29, 2017 (the date that Owner acquired the Property). <br />"Gross Income" shall have the meaning set forth in Section 6914 of Title 25 of the <br />California Code of Regulations as such section may be revised from time to time. <br />"HOME Affordability Restriction Period" is defined in Recital D. <br />"HOME Funds" is defined in Recital B. <br />"HOME Program" means the HOME Investment Partnership Program established and <br />operating pursuant to 42 U.S.C. 12741 et seq. and 24 C.F.R.
